Re: Bryan carter Solicitors -asking to confirm residence

How long ago has it been since you stopped paying this CCJ? You say you were getting bailiff letters in 2006 then stopped. Anything later than that? The creditor has to go back to the court if they wish to enforce the CCJ via an attachment of earnings or a warrant to send bailiffs round, and if it's been years without you making any payments, the court would wonder why they didn't attempt to enforce it earlier.

If someone is just asking you to confirm your residence, I'd be inclined to ignore. If someone sends you a specific threat, whether it relates to a CCJ or not, do come back and post up.

    Sorry for replying so late.

An update: And this is down to my complete lack of knowledge re: ccjs, I'm really hoping someone can advise.

So I have still not heard from BC which surprisingly I find unsettling and this is why....
(I will try to be brief and as informative to the best of my knowledge)

In roughly 1999/2000 I took out a personal loan for £k after paying back for roughly a year or so I found myself in terrible financial difficulty and defaulted on the the loan (it was that or lose my home) in 2003 I sold my home (that or get my home reposed...I had notification on more than one occasion for repo. In that time I was plagued by one bailiff letter after another but me being me I burried my head in the sand in the hope it would go away. Things got so bad I ended up selling my house a getting a smaller place in.
Within months I was plagued by bailiffs at my new property.

Eventually I got a ccj, and agreed to £50 a month I think. Was paying for a while and things became difficult again and I stopped paying again. I was young and didn't understand the ramifications of a ccj. Again I received bailiff letters, would get them for a few months and then they just stopped. Until 2006 (roughly) I received a call at work, from a different bailiff who kept asking me "do you acknowledge the debt" I kept saying what do you mean your calling me and he'd ask again until eventually I told him I'm at work I'd call him back to discuss. Then started to Google old debts and found statute barred...anyway, armed with my new found knowledge (or so I thought) when they contacted me again I stated it was statute barred and hung up. The letters and calls stopped for a few years, then I'd get a call again, this time from a different collector and I stated it again and they stopped...for years,. I'd hear nothing for a long time until this letter from Brian carter asking for me to confirm address etc.
Now I realise ccjs are not statute barred.

Thank you all for your previous advise, but now the circumstances have changed (and I'm not so confident) does my stance change? Is it best that I do contact them?
As the debt has been sold, are they aware/have paperwork of ccj
I really don't want bailiff at my door.
Just to keep you all completely in the loop, I sold that flat where I got ccj in 2010 I didn't make any profit to pay any debt back or I would have. I have moved a few times since I quoted statute barred but thought that was the end of it.

Can I say, I'm still not sure this is what I've been contacted for. It could be one that is statute barred.

Please please help me, I feel sick since I've come to realise the whole ccj situation.

      Many thanks.

Hi flaming parrot and thanks for responding.

I taken the advise that you and many others advise and ignored the letter...I'm sure I will receive one at some point informing me what it's for.

With regard to ccj, I believe that there is a strong possibility that they are unaware of it. (At least I hope so) and if they are I would argue that up until 2010 which was when I sold my property they had ample of opportunity to enforce it up to that date? The debt is so old I can't even recall dates properly. I have checked my files on my computer and I think a dc called eci? Had it as they where the last people I wrote to in 2007 regarding it. Looking them up they seem to no longer exist and closed up shop a couple years after....
I'm certain lowell have written to previous addresses as one was when I was staying at a friends and I know they wrote there but I ignored it.
With regard to bc, I'm really not sure what debt they are contacting me about as I was in so much. But I do know all of these others are definitely SB.

I really appreciate you getting back to me. Everyone here is so amazing.
      Thank you

Sorry, also in answer to your question regarding last payment, I have checked bank statements and I haven't paid anything towards any debts since way before 2006.
