    hi im new to this forum and really need some advice
    The short story is barclaycard have sold a debt of £4.00 from 2002 to capquest and now they are persuing me agressively for a debt of £84!!
    This is the first i have heard from capquest. They are saying that they have put a black mark against my credit file and are now threatening to take me to court.

    I am trying to speak to Barclaycard complaints department but to no avail at the moment. I
    i have taken legal advice and my solicitor has said that this is illegal and breaches the terms of the Limitation act.

    Can they take me to court.?
    Can they put something on my credit file?

    what should i do??

    any ideas greatly welcome....

    Have you checked your credit files? Recording a recent default on a debt that old would be completely out of order.

      Are you sure you mean Barclaycard sold a debt of only £4 ? It would cost them almost that much in postage, and I'm not sure anyone would want to buy it. Could it have been a higher amount :noidea:

        yes the debt was £4.09 and cap quest bought it and now want £84.09!!
        however barclaycard have now agreed that they should not have sold this debt on and have now compensated me £150.00!!! Thank god.

            Hang on a minute. At 6.35 pm tonight you posted that you hadn't been in touch with Barclaycard. So I don't get why you are now saying they've offered you £150 compensation a couple of hours later Do let me know how you managed to work this small miracle.

                  I had a reply to an email to HSBC customer services come through at about 3am on a Sunday morning once, so who knows what weird hrs are kept. And yes, it did actually appear to have been sent at that time from looking at the email headers.

                      HSBC Outsourced to Asia no doubt, as would be about 10 or 11 a.m. there depaends on regional office used.

                        Nope. Was definitely a reply from someone in the UK, and wasn't on a matter that those type of outsourced operations could have dealt with.

                        Anyway, point is that nowadays customer service decisions on refunds etc aren't always decided, actioned or communicated by Mon-Fri 9am-5pm staff.

                          It wasn't a couple of hours Plan B , the first letter came through on Thursday morning and after a sleepless night I rang Barclaycard around six times before I got to speak to a complaints manager. I wouldn't have posted a question on here if I knew they were going to offer me compensation ! But I thought it might be useful for anyone going through the same situation to know that sometimes these big companies do hold their hands up and accept they were wrong ,
