Hello Everyone. I am new to this forum and would be grateful for some advice. Lowell have been chasing me for a debt with a bank dating back to 1992 - yes 20 years ago. All of a sudden 2 years ago I started receiving demands for payment from Lowells and their associated companies and todate have received 21 letters and there was not attached to anyone of those letters one piece of evidence as to why they say I owe this money. This week I received a statutory demand from BW Legal. I don't think for one minute, due to the age of this alleged debt that they have any paperwork in support of their claim, as other debt cos have chased me in the past and given up. As soon as I received this stat demand I emailed them to requesting that the provide evidence of their claim and to provide this within 14 days and that if this was not produced and they continued to contact me I would consult a solicitor which I am reluctant to do due to the cost. I would be grateful for your thoughts please.

Hi and welcome. You need to start your own thread on your issues and I've alerted the mods to assist you in this. You'll find a lot of assistance here. First thing: don't worry, please. And don't go near any solicitors just yet: Lowell, like a lot of DCAs, have discovered this new weapon, the SD! However , I will say this: you MUST apply to have the debt set aside within the time limit indicated on teh SD, usually 18 days, IIRC. BTW, how was the SD served?

Get this set aside. It won't cost you anything to do, but may well cost Lowells.

Who was the original creditor? Was it a credit card debt or a bank overdraft? Was your request to provide evidence of their claim sent as a random email or did you make a formal request under section 78 Consumer Credit Act 1974 with a £1 statutory fee? I know that's a lot of questions but we need to know all this information before you can be properly helped.
Send a PM to Celestine the site owner who has successfully had over a dozen SDs withdrawn or set-aside by Lowell and they paid her legal costs too
Add a link to this thread in your PM :typing: I would do it today, in fact do it as soon as you see this post, because Celestine works round the clock which means she'll probably see your PM over the weekend. We've got a Bank Holiday long weekend so no contact can be made with BW Legal until next Tuesday and there's a very tight deadline to deal with SD set-asides (18 days) so the clock is ticking for you :clock:

Tobydog1 - I can see you are online. It's in your best interest to pop up and discuss your case, given that a Stat Demand is involved. If you do, or have done, nothing about responding to it, you could be made bankrupt. If you feel safer, you can PM members but it's best to give us some info on what you've done.

Can you tell us whether the original account with the Co-OP (?) was for a credit card or a bank account?
