    Hi,
    New here having researched Restons last night and found the info helpful, I need to see what my options are regarding an alledged debt.

    I have been contacted by Rstons who having been trying to locate me which I find surprising as i am not in hiding, anyways I digress, I have return their enquiry today to discover they are acting on behalf of Hitachi finance for a debt I was paying off up to November 2011, I recall trying to contact Hitachi at that time to obtain a balance on any outstanding amount to which i received no reply, I then took the step of stopping the direct debit/Standing order I had set up as this generally gets creditors attention and they contact you to find out why payment has stopped, needless to say this did not happen, I never received any communication from them and I did not persue it further, I have not received any correspondance regarding this matter until the letter from Restons yesterday.
    What i would like to know is what are my options now given that they have not persued this debt in nearly 2 years, Restons claim Arrow global have attempted to contact me yet I have no recollection of this and would have responded had they done so. Can this debt still be persued or are there limitations?


    Any advice would be greatly appreciated.

      Hi and welcome!

      There are limitations but they wouldn't apply to your case since you were paying up to November 2011, there has to be a clear 6 year period without any payments or written acknowledgment for a debt to be Statute Barred (5 in Scotland). :clock:

      When did you take out the loan? Was it before April 2007? It could be significant. :thumb: What's the outstanding balance?

      Arrow Global and Restons are both aggressive and prone to litigation so it's not a good idea to just ignore them. It may be worth sending Arrow a CCA request and copying Restons in on the letter. You'll find a CCA request letter here: http://www.legalbeagles.info/forums/...965#post365965

      It should be sent with a £1 PO and signed using a computer font rather than your real signature. Send it recorded delivery so it can be tracked. :grin:

        Thank you for the replies, i have to say the lady at Restons was very gracious and happy to discuss extending time to sort out paperwork as i was not sure whether this had been part of a repayment agreement i had set up with Westcot which i finalised settlement on in 2011. it is not a great deal ,£320 but what irks me is I paid religiously for 5 years on the account, they NEVER sent me a statement or receipts for payments sent and when i attempted to contact them to clear the outstanding balance I received no response at all hence i stopped the direct debit thinking that would get their attention, clearly not, now 2 years on and they are whining for the rest of their money.


        ps. the restons letter was extremely vague and and merely stated they required speaking to me regarding a 'Personal Matter' (not Financial)
