    Hi there I hope somebody can give me some advice regarding a recent correspondence I have received from bpo collections regarding a council tax outstanding balance going back to 2001. I lived in Glasgow at the time and have since returned to England and have been living here for 13 years. Unfortunately I was unwell around this time and have no idea what I paid with regard to this claim.

    They have given me 30 days to respond with details of payment etc , of which I have none and I believe that statute barred in Scotland is 20 years with regard to council tax. After this time they have said the account will be referred to Walker Love , Sheriff at arms. This is the first time in 13 years I have had any communication regarding this supposed debt

    Surely I need some proof before I respond . I am on disabled benefits and would have to pay in installments if this is proved to be a genuine outstanding account.

    Although the Payplan website states that councils won't be able to apply to the court for a Liability Order after 6 years:

    Council Tax

    If the Council Tax was due more than 6 years ago then the council are unable to ask the Court for a Liability Order (a liability order allows the council to deduct the Council Tax debt from your wages or benefits). However, it is unlikely that the council will have allowed this to happen, and they will usually have obtained a Liability Order before the 6 years are up.

    ...it looks like they can pursue you for up to 40 years in Scotland: :scared: :scared:

    CAS has also recently published evidence of problems with the legacy of community charge debt. Although replaced by council tax in 1993, the unique Scottish collection system means that community charge arrears are still being collected. Local authorities can apply for a summary warrant to collect outstanding monies from both community charge and council tax up to twenty years after the amount has become due and then have up to a further twenty years to collect.

      Thank you so much, it has taken me 13 years to climb back from that awful place, and now , I feel as though I should not have bothered.. who was I kidding..have a nice life all ..checking out

        It is up to them to prove you owe the money. Ask them for a copy of the Liability Order + Sherriffs Officer have no powers in England.
