    Hi people.

    I've been registered here for a while and i'd like to thank all the people here who take their time to help the others posting. It's such a good resource for people who would otherwise not know which way to turn!

    I'd now like to get some help with a problem i am having with JBW Group.

    TFL had issued a fine for a vehicle that I no longer owned in january 2013. I had produced evidence that i part exchanged the vehicle in December 2012, but the new owner had obviously failed to change ownership details and the garage i part exchanged with didn't send off the sale of vehicle part of the V5(something i later learnt i should have done). The only thing was DVLA had a totally different date on their systems so i wrote to them to get this changed - which has now been corrected and i have a letter confirming this from them. The new owner put a date well after i actually got rid of the car - i know for sure he was driving it around in January as thats when the ticket was issued for illegal parking.

    I had contacted them to state i wasnt the owner at the time and provided the garage's contact details and also the change of insurance from the old vehicle to my new one on the date i part exchanged it. I hadn't found out about DVLA having different dates on their system at this point so fair enough they were just going after the registered owner, but since providing the proof to them they are not giving in!

    After many threats of a bailiff, emails, texts and all sorts from JBW a bailiff turned up at my property and i sent him away with a flea in his ear and told him i was awaiting DVLA to confirm the date i ceased ownership of the vehicle. Once i told him this i walked away and told him I have nothing further to discuss - he then threatened to get a locksmith to which i politely told him to try it - knowing full well he didn't have the authority nor reason to do so(i referred him about if the debtor named is doubted to own the money then he needs to jog on) - with that i walked off and took the dog for a walk around the block. By the time i was back he had gone!

    I wrote a very stern email to JBW stating i didn't appreciate the harassment considering i had provided proof i was not the owner of the vehicle at the time the ticket was issued. I also stated that the bailiff in question threatened a locksmith and they told me they could have done(which is rubbish). The bailiff of course denied this when they spoke to them! The bloke i spoke to on the phone was not helpful and even tried telling me i had driven the car around without insurance. I asked him why on earth i would transfer the insurance from the old car to a completely different car and then drive the old car 80 miles away from where i live IN LONDON without insurance to which he replied 'well people do!'. So basically he made assumptions i was lying and driving illegally! I also told him the supplied photo on the PCN show quite clearly a foreign looking asian chap next to the car and stated i was a bald white male who didn't even look like the guy in the photo - he stated it might not have been me driving - fair comment but still he wasn't listening to the other FACTS!

    I then followed this unhelpful call up with another email and I told them further contact would result in me taking action against them for bullying, harassment and not following proper procedure. I also stated that any further visits would be deemed unlawful and i would seek compensation of £250 for every time they tried.

    Anyway after a few more letters and phone calls i'd had enough and sent an email containing a letter revoking their implied rights of access and also stating that any further communication and i would take action under Section 3 , protection from harassment act 1997

    Since then I have had many emails, text messages and letters all threatening the bailiff if i didn't make payment. So many that i consider it to be bullying tactics. Today i received one stating it was a final notice and unless I paid they would send the bailiff round and also their ANPR vans would be notified of any registration plate on a car i owned and they would seize it and take it to a compound.

    I have provided all the proof i had that i wasn't the owner yet they pursue me still - so now i've had enough and want to hit back and take action against them, this is where i'm hoping someone has an idea what i do next as this is getting ridiculous and causing me no end of stress and distress.

    So anyway is there anyone who has an idea what to write to them to sort this out once and for all. Also what action i should be taking against them as it's so clearly visible i was not the owner when the ticket(in fact theres a few but one battle at a time!) was issued!

    Transport for London need to be contacted regarding the conduct of their contracted enforcement agent.

    If you no longer own the car involved and did not own on the date of the alleged offence, JBW should not be pursuing you for the PCN. The person with whom you spoke at JBW had no right to make the remarks they made without evidence to corroborate what they were saying.

    Speak to TfL first thing tomorrow morning.

      Thanks bluebottle - it's outrageous the amount of texts and emails they have sent! not so many letters. one or two, but the texts are relentless! i would say they have texted maybe 3 or 4 times a week since the bailiff came knocking!

      What stance should i take with TFL? it's clear JBW's conduct leaves a lot to be desired but what do you recommend i say to TFL?

          Explain the situation regarding the vehicle to them and the conduct of JBW. Stress that they, TfL, are 100% vicariously-liable for JBW's actions. As for JBW texting you 3-4 times a week, I would save the text messages as evidence. Someone has certainly bungled and needs to be held to account. Get DVLA to explain their bungling and why they provided TfL with your particulars when they knew you no longer owned the vehicle.
