    hi guys, its been a while so I'll quickly fill you in. I have been pursued off and on since 2008 regarding a debt of £603 I apparently owe, this debt has been passed from one DCA to another over the last 5yrs, I have written to each of them over that time requesting proof which none of them have been forthcoming, the last one was in oct 2012. Now out of the blue I receive a letter from rossendales telling me I have failed to respond and that the payment which I owe will be pursued and the company will utilise its expertise in this matter. What do I do? Its driving me nuts. any advice would be appreciated, I have 7 days

      Hi and welcome to Legal Beagles.

      If none of the DCAs who have written to you have produced proof that a lawful debt exists and that it can be attributed to yourself, then it is logical that they cannot and will not be able to produce proof unless they fabricate it.

      I would be inclined to respond to Rossendales and give them 7 days in which to produce substantial and irrefutable evidence that a lawful debt exists and that it can be lawfully attributed to yourself.

      If they fail to do so, then reporting them to OFT Credit Fitness Team and Trading Standards is a start, as it sounds like you have had a letter from Rossendales' Debt Collection arm, not their bailiff arm.

      The letter you send to Rossendales could be along the following lines -

      "Dear Sirs,

      Reference: xxxxxxxxxxxxxxxxxxxxxxxxxxxx

      I am in receipt of your letter dated [date] in which you allege I owe a sum of money to [name of alleged creditor] and of which I have no recollection or knowledge.

      You are put on notice that various other debt collection agencies have attempted similar to yourselves and when challenged to produce evidence that a lawful debt exists and that it can be lawfully attributed to myself, they have failed to do so. I now require that your company produces evidence that a lawful debt exists and that it is lawfully attributed to myself. Should this not be forthcoming, I have to regard the demand you are making as unwarranted and the threats contained within your letter as improper. This may result in my referring the matter to the appropriate law enforcement and regulatory agencies without further notice.

      I look forward to your response within seven calendar days of your company's receipt of this letter.

      Yours faithfully,"

      See what response you get and should they persist in behaving like numpties, come back onto this thread.

            In that case they are onlyacting as a Debt Collector and have no more powers than next doors cat. If they do call then ask them if they enjoyed their trip out as you shut the door on them.

              Rossendales act both as DCA and bailiffs, they use the fact they are better known as bailiffs to scare debtors when they act merely as a DCA. :mad2:

                  hi everybody, again its been awhile, but since my last visit and the advice from bluebottle back in june, I did write to rossendales and so far no contact, but what I have discovered is that, this debt has appeared on my credit file with another surname different from my own but is showing the same forename? can anybody help in getting this removed from my credit file x many many thanks xx

                      It sounds like someone has goofed. Get onto the credit reference agency and ask who put it on there and when. You have the right to have it corrected.

                        hi everyone, I am in need of some advice please regarding a default notice on my credit report I have just received. if you look back on my latest post you can see I have been chased by many dca's and not one of them came up with any proof that I owed this debt. The debt defaulted apparently in feb 2008, I have never made any payments or acknowledged that the debt is mine. My question is, is this debt stature barred now and if it is can I get it removed. this is the only negativity on my credit file and its affecting my chances of any credit enormously. many thanks xx
