  • When a hearing is vacated

    Two weeks prior to a small claims hearing was due to be heard of which I am the defendent I recieved a letter from the court saying the hearing was vacated. Today, I have received a letter from the claimant saying they will be obtaining a judgment. How can they do this?

    The most likely reason is that the judge or courtroom are now unavailable on that date. The claimant may also have indicated that they wish to amend their POC. If in doubt, telephone the court for an explanation.

    In all probability, the claimants letter is flim-flam.
