Ok hi everybody i'm new to this site so forgive me if i'm posting in wrong section but need help desperately.I have 3 hp agreements with Brighthouse ltd a tv laptop and a bed,all overpriced c**p.I have had the bed agreement the longest being just over 7 mnths the laptop 5 mnths and the tv 1 mnth.Never missed a payment upto 9 days ago when i requested a copy or breakdown of what id paid upto present (which i didn't receive) and also that my benefits have been put on hold as im disabled going through some problems with my dla but that's another story.Anyway its been 10 days and iv'e had two knocks on the door regarding my items obviously wanting to repo as they came in a nice white transit van.First time i didnt answer door second time i printed off a nice cease and desist letter and removed rights of access to my property and handed it to them at the door when they came .Firstly im not willing to pay them until they give me a breakdown of what ive paid upto date also thay havent sent me a breach of contract or a notice of default or any paperwork to be honest,just turned up banging on the door.The question is im trying to get my payments lowerd and im happy to go to court to do this as they have not provided me with the requested payment information to date and just tried bully boy tactics which will not work with me Are they in breach of there side of the agreement and also i have not sold the items im watching my cctv through the tv right now and im writing this on the laptop,Can i be arrested for anything criminal,ie is it criminal offence to not pay hp agreement if the other side has breached there terms and conditions by not sending me the requested info and also by not sending me even a default notice and myself not paying them as im waiting to go to court about it with them and i have not sold the items they are still in possession.Any feedback will be greatly appreciated as i dont want a criminal charge for this but principals are playing with my judgement on this one and ive also found im not the only one who has had problems with this company.......

Hi and to LegalBeagles...I can't answer your immediate questions re:repossession but can I ask,,have you taken on their extortionate DLC and OSC?? If you have then you need to get them taken off,,they have no purpose and although Brighthouse will INSIST you have to have them you don't and you can also apply for any payments back on those you may have already made.

Am i correct in thinking that the osc and dlc are not enforceable on the agreement where there has been payment default over seven days and yes was forced to take them both otherwise wouldnt of received the goods.:tung:

Hi and welcome to Legal Beagles. May I recommend you stay on this thread as you appear to have two threads going. Keeping to one thread avoids confusion.

It is not a criminal offence to not pay HP installments unless you are acting dishonestly or fraudulently. It is, ultimately, a civil matter. Brighthouse are well-known for their non-compliance with consumer protection laws and bully-boy tactics.

As far as I am aware, if you request a statement of all payments to date, this should be provided. If Brighthouse insist otherwise, speak to your local Trading Standards Department (TSD) who have probably got a bulging file of complaints against them, and ask them for advice as to how to deal with this. If they consider Brighthouse have overstepped the mark, it is possible that they may take action. However, you need to speak to your local TSD.

I have just noticed that you say you are waiting to go to court with Brighthouse. What is that about, please?

Hi bluebottle im not as such waiting to go to court but im prepared to go to court as they have not provided the correct signed contracts on there behalf,they have not given me a statement showing exactly what i owe etc.As for court im thinking that maybe a better route to go with them if they apply for a court order to remove goods i can put my case to the court.Im just worried the fact that they are the legal owner of the said goods until full payment is received to themselves and i have asked for full title of the goods to put in my name in black and white.Im just sat here waiting for the police to arrive either with them to prevent a breach of the peace or to arrest me for not giving them the items back that they (apparently own).Thats the disturbing bit,i dont want to be arrested for not giving them the items back but i want to see how far the law will allow me to go without getting arrested.....I will keep the forum updated in due course................any further advice regarding the criminal aspect of this problem (or non)would be much appreciated..........

Plus i havent acted dishonest or fraudulently.I am who i saw i am, i have not sold the goods there are in my home which is the address on the contracts which brighthouse have.I just dont like the fact of the bully boy tactics just turning up at my house with a van to remove my goods without even a letter of default or arrears letter etc ? ps sorry about the second thread im new and will stick to this thread in future

Some of our members are more experienced in matters pertaining to Hire Purchase than I am. My background is in Criminal Law, having served as a police officer. If you have paid the amount or more than the amount which requires Brighthouse to obtain a court order to repossess their goods, turning up at your home demanding entry and return of the goods is illegal.

Attempting to repossess simply because you have asked for a Statement of Account is not on. Put them on notice to provide you with an up-to-date Statement of Account. If they fail/refuse to do so and continue to harass you, you may have to consider legally-restraining them. However, that should be a last resort measure and only used if absolutely necessary.

Im really sorry but this sounds like you just want to wangle out of paying. I used to work for BH as an accounts advisor, so i will tell you the truth. The big white van is not a removal van it is a company vehicle as they need a large van to drop or swicth out large items. It IS NOT a repo van. Having the TV under a month a defaulting on payments is pretty poor financial mangement, you can not reduce your HP prices after a few months, imagine i got a new car and after 1 month into a 3 year contract i said can you lower the monthly price???they would take the car away. what you should do is just returnm the items to stop the arreas building up and when you get them back you have paid off what you ahve paid off, and there is no arreas. Basically you dont have protected goods status on any items so they should be returned, once you have PG status, thats a diff matter, but using an excuse of wanting to see what you have paid off and witholding payment is an excuse, they here this all the time....

True words touble is Brighthouse and others sell to the poorest and most vunerable whose credit rating is low for which they pay a premium as long as all the charges are upfront its Buyer Beware pay up or don't a face the consequences?

I very much doubt that is the case if things are so recent. Far more likely is they would have asked for (and checked) proof that the items were insured through your own home insurance.

Also, having acted as a referee for someone who had goods with Brighthouse, they tend to phone them first to see if anything can be done to resolve the problem.

You definitely can't be arrested for a civil offence. Brighthouse have to be fairly aggressive in their pursuant of non-payers, as due to their typical customer, once the customer falls into default it is likely to become a long term default if nothing is done. They usually go out of their way to procure payment on time via a chase up phone call etc... Did you receive any of these?

Are you witholding payment until you get the statement of account, or are you having problems, and possibly have overstretched yourself?

I thought you could hand the goods back if you could no longer afford them and that would end the contract or am I mistaken? If not..that seems to be an option OP could consider
