  • debt relief order wanted, spouse is undischarged bankrupt, any complications???

    Hi,
    My husband is wanting to apply for a debt relief order asap for the growing amount of credit card debt and interest he has since he was made redundant 9 months ago. I am an undischarged bankrupt due to be discharged end of June 2013, what effect will this have??
    Also when working out income and outgoings im not sure of the complications as our income if joint benefits so would his income when working out DRO literally be half of what we have in/out???
    And if I was to get a job after i am undischarged, will this then mean that I am persued for his debts?
    Any advice would be much appreciated!!
    Thanks

    I am an undischarged bankrupt due to be discharged end of June 2013, what effect will this have?? It should not affect you in terms of being discharged.
    Also when working out income and outgoings im not sure of the complications as our income if joint benefits so would his income when working out DRO literally be half of what we have in/out??? A DRO is part of a formal insolvency procedure, as is bankruptcy. The paperwork and issues of this type would be completed by them. I doubt it will be as simple as simply halving benefits.

    And if I was to get a job after i am undischarged, will this then mean that I am persued for his debts? You could be liable for any joint debts incurred that were not part of your BK. The BK should have limited the limit on your lending without permission to I think £500.
    Any advice would be much appreciated!!
    Thanks

      Would you care to tell us a bit more about those credit cards? There may be other ways to deal with them, I have just over £15k worth of CC debt which is over half way through to statute barred and I didn't have to resort to any form of insolvency. Could you give us some details about those cards? :typing;
