So yesterday marston bailiff put a notice of distress on my car and because of this my partner has taken his car back he is the legal owner I'm the registered keeper...... The bailiff seems to think I am the legal owner even tho I have the proof of purchase from the private seller. With the car no longer being here what can happen now the bailiff has put this notice on it??

Was you partner the legal owner of the vehicle at the time Marstons put a notice on it? If so, the levy is invalid and unlawful as the vehicle is third-party property. What is the distress in respect of, please?Life is a journey on which we all travel, sometimes together, but never alone.

If your OH is still the legal owner and can produce proof to the bailiff, the bailiff cannot remove or seize the car as it is third-party property. Expect the bailiff to deny this and attempt to remove. He does so at his own risk. Better still, get your OH to swear a Statutory Declaration as to ownership of the car.
