      I have missed a few replies on here so to clarify the situation: As far as I'm aware I originally sent a CCA request accompanied by a £1 cheque to MH, as advised earlier in this thread. They sent me the cheque back accompanied by a letter saying that they would reply within 40 days. Thus, it seems that they turned the CCA request into a SAR request, something which was noted earlier in this thread again by those who know a lot more than me. Hence the 14 day CCA period has massively passed but MH will no doubt argue that it was a SAR request not a CCA request, given that they turned it into one no doubt to allow themselves more time. I haven't calculated it but I think the 40 day period has probably passed anyway. I have subsequently received - which I will scan and post - the letter referred to in my previous post above, giving me 10 days to contact them, and a copy of a 'signed' agreement that is dated 2006 as per my comments above. Hope that clarifies the situation, thanks all. Will post the stuff I've received shortly.

        I wouldn't worry about the 10 days. I don't think they're in a position to dictate to you over much. The fact is they probably knew they couldn't enforce without a CCA and they couldn't get the CCA within 14 days, so they returned your money (unusual for MH) and sent you the CCA when they got it.

        There's nothing wrong with any of the above. It just means that if the agreement is compliant, MH, after jumping through a few more hoops, will be able to enforce it.

        The main thing now is for us to see the agreement and the T&C's. :beagle:

              If Muck Hall ever take you to court it will be a first for them. The only time they are liable to see the inside of a court will be as defendants

                Ah yes, of course and it will be interesting to see...
                However, the mere fact that the account is with Mucky is sufficient to show that it must be a dead donkey debt!

                    Hi all,

                    I can't upload the necessary info due to file size apparently - any advice? Only the loan agreement will load but not the T and C due to its size, nor the letter itself from MH. My original letter to MH with a CCA request was mid-May by the way.

                        Try doing it over two threads, or Google to find somewhere that will reduce the file size for you - there's loads on the net.

                            What file format are you using? Is it JPEG or PDF? Did you use a scanner, digital camera or mobile phone? The agreement itself is the most important document of all, the covering letter isn't likely to be relevant so don't worry too much about it. :typing:

                            As for the terms, they need to be the ones that relate to your agreement, at the time of account inception. If they've sent you various sets of terms as varied later on, we don't need to see those, just the ones that, according to them, were present at the time you allegedly signed the agreement, i.e. the ones you are supposed to have agreed to. :thumb:

                              Hi, as asked above it's a Pdf using a scanner but I'll see if I can reduce the file size somehow or do two posts instead.

                              What is IFYPFY by the way?

                              As I say, no idea if what they've sent me is legit or real, or original, and no idea how I'd tell to be honest.
