    It is.

    If they can subsequently cobble together a reconstituted "twue copy" agreement from different sources which may or may not include the lining of the office cat's litter tray, then it might become enforceable.

        Still no response so should I contact them to say its now unenforceable or should I just wait and see what happens next? What is a SAR request as opposed to a CCA request? Thanks in advance.

          A CCA request simply asks for a copy of your original agreement. They have 12 working days (plus 2 for postage) in which to respond.

          A SAR gives you all the information they hold about you, and is requested under Section 7 of the Data Protection Act 1998. They have 40 calendar days in which to respond to this.

                  No need to contact them at all, they said if they couldn't provide you with the documents they would close the account, that's exactly what you want! :thumb:

                  As noted above, a SAR is a request for all data held about you under the DPA. You would send a SAR to get hold of statements and other documents such as letters, file notes, etc. which could be useful for things like reclaiming PPI, but not really to establish whether an account is enforceable or not. You'd only send a SAR to the original creditor, not the DCA who wouldn't have any information. There's a £10 fee.

                  A CCA request is a request under s.77-79 of the Consumer Credit Act, for a true copy of your credit agreement. Non compliance makes an account unenforceable until the request is satisfied. :thumb: :grin:

                    Once again, many thanks for your advice and very thorough knowledge. Also I appreciate the advice re SAR and CCA and certainly didn't request the SAR. I will do nothing, as suggested, and see what happens.

                            Have you checked that your SAR letter was signed for on the Royal Mail site? :confused2:

                            If it was, your first step should be to write to them, enclosing a copy of your SAR letter and the proof of signature. Once you've done that, in the absence of a suitable response, you can go on to complain to the ICO, but you have to write to the company first: http://www.ico.org.uk/complaints/getting/complain

                            Looking back at this thread, it's not entirely clear whether you actually sent a SAR and if so, who it was sent to. :noidea: As a DCA, Murky Hall wouldn't have the data you'd normally be after when you send a SAR, such as statements and other documents relating to your account. A SAR should normally go to the original creditor rather than the DCA. :thumb:

                            If it was a CCA request you sent then it should have been responded to in 14 days, not 40.

                                I've actually received a copy of an agreement this morning! It's signed and dated Oct 2006 - no idea of its legitimacy. There's a letter asking me to contact them within 10 days. Obviously the 14 days is long gone and I think even if it was a 40 day one that's probably gone too. Any advice? Thanks in advance.
