  • motor insurance bureau debt

i would be grateful for any advice or any one knowing of experiences with these people...we owe 56k...and are worried to death we will loose our house....its a long story...but in brief..a pile of youngsters came looking for our daughter after an arguement...years later we had letter saying they were claiming that my husband had chased them in the car...rammed them off the road...totally fictioional...we decided to fight the matter in court...but we lost...hence this debt for compensation and court costs....the solicitor who was representing us said it was the worst misscarriage of justice that he ever saw....we now have this debt...and they are looking to recover this debt...we have a mortgage of 28k on a house worth 99k...we cant afford to remortgage...we have 2 kids 12&15...worried pig sick that they will make us sell our house so they can have their money...we cannot appeal as this will cost more again ...we just need some insight as to what could happen...or where we go from here?? all comments gratefully received...we are both under the doctor for depression and distress..hubby suicidal...

How on earth did the MIB obtain judgement? Were the police involved in this matter?

there were no police involved...We went to a county court and the judgement was passed that the youngsters had compensation..it was a joke..the judge was sleeping most of the time if the hearing..

he raised question of appeal...but it would cost lots more on top..and we were to frightened to take this chance...the juge was asleep on the bench..his eyes were closed for at least 70% of the case.

Could you provide full details of the alleged incident, please? In particular, did a collision actually occur? Did they claim that an ambulance was called?

the claims were laughable..anorexia?whiplash? the alleged ramming incident never happened...we have been scammed..totally unfair..we could loose our house...and these youngsters have walked away minted..

they came to our home looking for our daughter to cause trouble...my husband chased them from our home...no collision took place no ambulance was called...they turned up at the local hospital a day or two later claiming neck and back pain.

So the judge didn't discount appeal. Do you have any means to ascertain the validity of the damages claimed ?
Do they live locally do you have any acquaintances in common that can cast doubt on their medical claims.

we just left the court room devasted..didnt know what had hit us...i was rushed in to hospital with a huge panic attack...dont think judge dicounted appeal...they had medical records saying the girl had anorexia for years..but it had gotten worse since the alleged ramming incident..the boys medical records indicated that he had obviously been faking whiplash.they have friends locally...but none willing to state the truth.i see the boy on a regular basis and its so hard to hold my tongue

Did your husband follow them in a vehicle at all? If not, my immediate gut-feeling is to advise you to report this to the police. How long ago did this incident occur and how long ago did this charade take place at the court?

he did follow them.the whole incident was on cctv..husband was done with public order..fine paid on the spot...matter closed.then just under 3 years later we had a claim for injuries through the door..it all happened in 2008...we went to court in july 2012.
