i recieved a letter from Buchanan Clark and Wells but nothing on the letter indicated what they wanted. i phoned them up and its a debt for my previous address which i dont dispute. i have recieved nothing from the company i am due the money to until this letter. i asked BCW for everything in writing and the right for them to collect this debt and they are refusing this request. what do i do next please any help is appreciated. emma x

Hi and welcome!
Don't phone them again and if they ring you, refuse to go through security and hang up. It's best to deal with these people only in writing. If they want to collect the debt, it's up to them to prove they have the right to collect. When the debt was sold, you should have received a notice of assignment (NoA). I would just ignore them until they write again, when they do so, post up here what they've said. If they write letters but don't tell you what they want, it's their privilege to waste their money and paper. If they refuse to comply with your lawful request to prove that they have any right to your money, why should you do anything?
When did you last pay or acknowledge this debt in writing?

hi there
i only recieved the letter over the weekend and phoned them today. the person i spoke to on the phone when i asked for everything in writing told me he had never heard of a notice of assignment and that i should be sattissified that they can collect the debt since they have written to me. i told him unless i get everything in writing then i wont be dealing with them and was told they would then take it further. as i am writing this they have phoned me back and i have hung up. i dont want to ignor this debt i will pay it but i dont want to pay to a company that shouldnt get it.

Presumably this is not for your current electricity and gas supply, if it is, it should be treated as a priority debt because your supply could be disconnected. You could send them the letter below:
Dear Sirs
Reference No.yz
I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of the Protection from Harassment Act 1997 as well as Section 40 of the Administration of Justice Act 1970.
If you continue to harass me by telephone, you will also be in breach of s.127 of the Communications Act (2003) and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you may be liable to a substantial fine and/or other sanctions as they see fit. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately. Yours faithfully,

Report them as a nuisance caller.
