  • Robinson Way-Valid complaint?

Hi, can i firstly say new to the site and after being told to check it out i'm very impressed with the quality of advice etc
The point i would like to ask advice /opinion on is this, around 4 and half years ago i recieved a letter from robinson way in relation to a gas bill from british gas, i was a little surprised to say the least as i'd never held a british gas account, i looked through the information and found it was for a address over 100 miles away from where i'd ever lived , the person they were chasing was 8 years younger than i and also had a different spelling of his name and different middle name .So after proving i was not the person they were chasing they appologised and told me they would remove it from my file .....job done ! or so i thought , two years ago they then registered it on my file as a default so it all started again, i was with equifax then and i registered a complaint through them , again had the appolgy and it was removed.....job done again I THOUGHT!!!!! , They have now put it back on under their new name heist.
I have contacted them on their expensive "045" number kept on the line for 35 minutes only to be told they will look into it .
My question is can i mount a official complaint about this , i know for a fact it cost my the chance to rent my ideal property and a few other issues-ability to shop around for a better phone contract etc,i have looked on the oft site but its not overly clear what to do and o dont want to spend my chasing these cowboys much longer .
sorry my first posted is so long winded but so frustrated that they just do what they want when they want
thans in advance for any advice

To extend the aphorism first coined by Oscar Wilde: to record incorrect data against someone is unfortunate, but to do it again suggests carelessness - whilst to do it a third time does rather indicate an attitude of depraved indifference to the veracity of the data.

You should not bother with the Office of Faffing and Twaddling, as it is a data protection matter. You should therefore complain via the ICO - (link)

Also see the ICO's notes on Section 10 Notices - link

I had a similar experience with Lowell s chasing a 3 mobile account, I had never had. It went on for nearly three years, like you i spent hours on the phone and on several occasions they assured me the matter was settled. Then only to find some months later letters started to arrive again.

Eventually I did what i should have done in the first place and sent a letter to the CEO copied to the original creditor, recorded delivery.

Couple of weeks later I got a letter of apology and I never heard anything since. I keep the letter to hand though just in case.

Bit of a update on this situation, both myself and experian have recieved replies from robinson way/hoist, there basic responce is , thank you for your notice of correction, we have looked into it and we cannot update our files without further information, they state that they hold a copy of my birth certificate, electoral roll and also have the letters stating that no further action would be taken by robinson way regarding this issue , but state that now due to a business decision hoist have now re instated it and my electoral roll and bith certificate do not meet their standards regarding proof, so until i can provide further evidence the default will stay, surely when they put this information on someones file its they who need to prove the information they hold is correct, my electoral roll shows i was living over hundred miles away , my ex wife held the gas account which was with npower, and my birth certificate clearly shows many years difference between me and the person they want , i really dont see why i have to spend time money and suffer having a default on my file after they have admitted twice they realise its not me , but their business desicion dictates they just put it back on , the ico are struggling to get straight answers too ...........so damn frustrating

(One can guess who will end up hoisted once the ICO gets going! msl

Why? How might they benefit thereby?

The ICO staff have powers of entry and search, so one would surely doubt they'd long tolerate Robinson No-Way playing at Silly Buggers with them.

You may need to serve a section 10 notice on RW.

Somehow, CC, I can't see RW being very happy about the ICO's Investigation Officers and a load of hairy-arsed coppers stomping all over their offices. They can also seize RW's IT hardware and software which would really stuff them. Also, I don't believe a word of the BS RW have tried to feed the OP.
