  • Debt for phone contract

    We are hoping for advice or pointers for the direction to research. My daughter was contacted recently by Lowell who claimed that she owed O2 some money for a contract a "friend" of hers took out in her name, without her knowledge, while they were at university. Said friend used his email address, his bank account and his address but my daughter's name. Last year he decided to leave the country but just left the phone contract open. The first my daughter knew of it was a letter from Lowell asking her to contact them, which she did. Unfortunately she knew how to get hold of the chap's father and asked him to pay the debt, which he did. She has a default notice against her name on Experian and is desperate to have it cleared. Experian say it is up to Lowell or O2 to clear it and both companies say they are not interested. It would seem that any leverage she may have had was lost when the debt was settled even though it wasn't hers.

    She has as much "leverage" now as she ever had, as the Leeds loonies recorded the default against her even though she had no contractual obligation to pay the debt.

    If they will not correct the data, the ICO may help them to understand the law.
