  • Iqor 3 letters from demand to offer !!

    Hi Guys,

    Is this normal practice or is this a sign they have not a hope in hell recovering the debt. My first letter was received 2 weeks ago demanding full payment, i ignored this letter. 4 days later a letter threatening they would arrange a doorstep visit and i better phone them, ignored this letter and started to draft a letter asking them to prove the debt. So 5 days later i get a letter saying they are willing to offer a substantial discount for immediate payment, i am just about to post the letter asking for my agreement.

    Is this normal practice or does this mean they are desperate?

          Thanks will look that up but does this quick succession of letters indicate anything or is it just completely standard. I would really have thought it would be later in the process before a reduced offer was made.

            The chances are that if they are offering discounts there is a possibility there is something wrong with what they are claiming. Have you submitted a CCA request to them? Is it definitely you they are after? Could the debt be statute barred? Could the debt be full of penalty charges or PPI?

              It most definitely is me they are after and i am about to send of the CCA request. The default notice is faulty as the amount demanded contains penalty charges. Given that fact what position does this put me in.

                  We are discussing this on another thread but focusing on the defective DN. what I would like advice on is this a sign they know something is wrong. Personally I find it bizarre they can go from start to finish in 2 weeks, I never even had time to write a reply and they are offering to slash my debt.

                      That doesn't automatically make it faulty, it depends on what those charges were.

                      A defective DN is only relevant at the court stage because it can be used as part of your defence as in Harrison v Link --> http://www.watsonssolicitors.co.uk/harrison.html

                      You haven't told us what this debt is for, how much is the balance, when you last paid, etc. so it's impossible to tell what could be 'wrong' with it. If you haven't paid or acknowledged in 6 years (5 in Scotland) it could be Statute Barred, in which case they wouldn't be entitled to collect it at all. Even if it's not SBd, it could still be unenforceable, but you won't know without sending a CCA request.

                        I get periodic influxes of amazing discount offers from 1stCredit...the debt is long since SB.....They all go in a folder which is stuffed under the stairs....unless I need kindling for the bonfire
