  • Help! Being hounded by Lowell and Red

    Can someone help me please? Divorced and lost house - triedto keep it but couldn't. This was in 2006 [November] paid off most debts butstill owed £23,000. Went to see a bankruptcy expert and wrote, asking Lloyds,M&S to make me bankrupt; heard nothing.

    Moved house in October 2012 and in December 2012 receivedletters from Red and Lowell re the old debts. I wrote and ask them to takebankruptcy proceedings; they declined. Since then I receive approx 6 letters aweek from both. What can I do?

    What else are they doing apart apart from boosting Royal Mail's profits? Are they making repeated telephone calls throughout the day, also? If so, how many times a day?

        Have you spoken to a debt counsellor about your financial situation? Go to the main forum page and scroll down. There is a link for a consumer counsellng service on the right-hand side of the page. Click on the link and it will take you to their website. You certainly need competent advice as to your current financial situation.

          You say Nov 2006, have you paid anything towards these debts since then? If not they are statute barred. Lowells and Red are trying their luck. Also if you have asked them to make you bankrupt and they have declined then there is very little chance of the actual companies chasing you for the debt as they know that as soon as they take you to court you will declare bankruptsy and it will then cost them more. Lowells has just bought a load of old debts and trying to scare you into paying something.

                If the debt was for a mortgage shortfall then it won't be SBd till 2018 as the limitations period is 12 years in this case not 6. Lowells are fond of making people bankrupt, they have been serving SDs like confetti lately so you may be in luck. There's no real way to force a creditor to make you bankrupt (as opposed to footing the bill yourself), when people tell them they wish to be made BR, creditors often assume you have no assets and they won't be getting anything back so don't bother. There are quite a few threads on here regarding SDs from Lowells.
