  • Motormile Finance default (never had an account)

    Afternoon all,

    I have looked at my CRA and found that Motormile finance have added a default to my CRA. They have said i took the debt out in September 2012 and then defaulted in December 2012. When I phoned them and asked them what this was about I was told that because I couldn't pass security they wouldn't talk to me.

    I have since realised that the debt was apparently taken out at my parents address (I moved out Dec 2012). No mail has been sent there either.

    Instead of ringing them again i sent them a letter with the correct address and my new address along with a £1 cheque (my partner signed it) to obtain a copy of the original CCA agreement. I also asked them to send me a copy of the original default notice. That was 28 days ago.

    I have heard nothing but they have cashed the cheque. Can someone advise me what i need to do next please? I am reluctant to send them a SAR request as i feel this debt doesn't exist and i would be just wasting £10.

    If you're sure you've never had an account with them (and one would assume you would remember whether or not you opened an account just 6 months ago) then I would be contacting the police and reporting a possible identity theft. It is unusual for such a recent alleged debt to be defaulted and chased at the wrong address... that normally happens much further down the line...

      Thats what i thought. Correct me if i am wrong but i am under the impression that debt collection companies can only change the name on a default and not the default date? I used to have a catalogue that defaulted that is now statute barred due to them being founf guilty of irresponsible lending.

      They cant then sell it to someone else and let them alter my credit file can they?

        They can still sell it because debt purchasers buy debts in bulk without looking at the paperwork, and many people are not fully aware of the Statute of Limitations and may still make payments. You can only be defaulted once for each account and the default should drop off your file 6 years after it was recorded, this date won't be the same as the date the debt goes SBd because defaults are usually recorded several months after the first missed payment.
