  • Another Capquest Situation

    My sister has asked me to try and help with a situation she's currently in as she's finding the whole thing rather upsetting and is unable to think straight.
    I have all the necessary information and I hope that someone on here with more experience than me can help.

    A few years ago she was in a relationship with a guy (not married, but living together)
    They took out a large loan with Alliance and Leicester in joint names (my sister's name was first on the paperwork)
    (As an aside they should never have got this loan, it was almost their full years salary combined)

    When they split up, A+L refused to split the joint loan into 2 individual loans, but did agree to set up 2 direct debits, each for half the monthly amount from each of their accounts.
    My sister paid this every month (failing only once when unemployed, but she cleared those arrears off quickly)

    When she had paid her half of the outstanding amount, she stopped the direct debit and thought that was that.

    In short order she received various letters from A+L (I have copies of all of these), stating there was still an outstanding balance of 12k to pay (It seems that the ex boyfriend hasn't paid a bean) and that as it was a joint account, she was equally liable. She did not pay anything more from this time.

    Fast forward a while and A+L changed to Santander (a change she was never informed of) her account was given a new number (again she wasn't informed) and then finally the debt was sold to Capquest.

    There has been a small exchange of letters (nothing acknowledging the debt as hers) and capquest have threatened to send agents to her house etc.
    When I heard that, I stepped in and have sent them a letter informing them that such threats constitute harrassment and they are denied the right to step onto her property.
    Capquest have also offered her a settlement figure of 6k (which she doesn't have, in fact she'll be unemployed at the end of the month as her contract has come to an end)

    I'm really not sure where to go from here, she's adamant that she's not going to pay her ex's debt, and has even provided Capquest with his new address etc but short of a bankruptcy I'm not sure what else to do.....
