Being taken to court by civil enforcement ltd tomorrow!!! Help!!

    It has NO court stamp. could they not file it tomorrow if they wanted to?? CAn I do that? Do I just ring the county court its supposedly being submitted at? Im just concerned that they could submit it in the future but again i am bankrupt so dont know how far they wouldget!

      it does look like a very basic later with no claim numbers or stamps so im hoping for my sake it is deception! Just hope they dont file the claim for real! thanks

        If it would have come from the court it would have had the response pack with it.
        Admission of claim , defence etc.

        Sounds to me that they have downloaded the N! from the net and just sent it to you to frighten you into paying. The threat being that they will send the other copy to the court on the date mentioned and commence the claim.

        I am just surmising mind you, but it seems logical knowing the depths that these people will go to in order to extort money.

        When and if you got the claim from the court you would have 14 days to file a defense( someone will correct me if I am wrong here, it has been a while).

          Ahhhh don't panic.

          This is a final threat with a 'mock up' of the Claim Form attached to convince you they are serious....except they might not be because it still doesn't mean they will actually file it. Such a claim would cost them at least £80, so I still think they are bluffing.

            They are trying to frighten you into paying and suppose may have succeeded if you hadn't have come here. I agree that in the past I would have said ignore these but nowadays I am more of the opinion everyone should appeal them first - OK I know the appeal will fail as it is not independent. Any appeal should go along the lines of getting them to quantify any losses - very difficult if a free car park - and asking to see proof of any arrangement they have with the landowner. After failing their appeals process they would have to give you a POPLA Claim which if submitted will cost them £27 +VAT, but some looking as if they going straight for Court in the hope of getting a default Judgment.

              If Civil Enforcement Ltd have no grounds or right in law for making the claim, the company and its management team could be in very serious trouble indeed.

                Thank you, i intend on waiting and seeing if anything comes of it! Its just a downloaded copy and a scare tactic, maybe they will submit it maybe they wont but reality is i dont have £75 to pay the original amount anyway! And im not sure how court works but i cant see a judge authorising a payment order (not sure of the official name!) onto a undischarged bankrupt on benefits, it would literally leave me unable to feed my kids and pay my rent etc so I cant see a judge putting me or anyone in that position......

                            To me, it does look rather like an attempt to use deception or a threat to sue to get you to pay.

                            I expect Bluebottle will have a better idea of which crimes may have been committed.

                              If the management of the PPC have no grounds or right in law to make the demand for payment of the £75 and assert they have, that is Fraud by False Misrepresentation (Section 2, Fraud Act 2006). However, if they then employ threats as a means of enforcing the demand, knowing they have no grounds or right in law to make the demand for payment, that is Blackmail (Section 21, Theft Act 1968).

                              Fraud by False Misrepresentation carries a maximum penalty, on conviction, of 10 years' imprisonment, whilst the maximum penalty for Blackmail, on conviction, is a term of imprisonment not exceeding 14 years.
