  • help needed: varde investments ccj claim started, through hl legal

    hi guys...

varde investments has bought my old credit card...looks like bmi American express.

asked for the particulars in the claim form. around dec 12 they wanted an extension(hl legal) gave it them, and they confirmed extend to 31 jan13.

no docs recived by 31 jan 13 so submitted defence( really edited a template i found) based on don't deny or admit as no documents provided.

got the documents on the 4th of feb 13. a bit late.

Ive attached the documents, for someone to have a look, and see how I can defend. I do not remember getting DN or assigment from them for a few reasons. 1. I moved house, 2. mail not forwarded.

HELP!!! i feel like im gonna go down the accept without prejudiced, no money £1 a month and CCJ BANG...

Have noticed the alleged balance is just over £5k, putting it just above the small claims threshold, which means you could get legal representation on a conditional fee agreement basis. You may consider contacting this of credit litigation specialists -> http://www.watsonssolicitors.co.uk/contact.html

Or PM PT2537 with a link to this thread - he works for that firm and has successfully defended a number of consumer credit cases, including this one -> http://www.bbc.co.uk/news/business-17670803, where the defendant is also a member here: Plan B

"Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. For example, the pion is invariant under the restricted Lorentz group, but is an isospin triplet (meaning it transforms like a three component vector under the SU(2) isospin symmetry). Furthermore, it picks up a negative phase under parity inversion, so it transforms nontrivially under the full Lorentz group; such particles are called pseudoscalar rather than scalar. Most mesons are pseudoscalar particles." (finally explained to a captivated Celestine by Professor Brian Cox on Wednesday 27th June 2012 )

They would have to obtain a CCJ first, then apply for an interim Charging Order, then a final CO. If the property is jointly owned and the debt is in your sole name all they could record is a restriction. Sadly COs are all too easy to obtain once the creditor has a CCJ, however, there may be other avenues to explore to prevent this in the first place, that's why you should really seek legal advice as noted above.
