  • BLS and CARS

    Well not been around for a while so got a couple of questions
    I have been paying back a Lloyds debt via a DMP and a payment book the payment book ran out of slips and after a few so called lost requests and a complaint to Lloyds they finally sent a new book and payments resume then out of the blue I get a letter from BLS stating lloyds have passed my debt to them for collection a bit strange seeing as Lloyds have just sent a new payment book plus £50 for dealing with my complaint and no word of passing on my Debt to anyone else.

    I also have a debt with Monument I have complained to them about my payments been passed onto Capquest all to no avail and now a company called CARS are chasing me I did write to them too stating I was awaiting response to a complaint with Monument and they also choose to ignore my letters and keep sending letters asking for payment
    Can anyone suggest logical reasoning for all of the above

    Sadly this is not uncommon with a DMP. Many think a DMP is a formal agreement, but it is not. It is totally informal, and either side can choose to back out of it at any time. It can be incredibly frustrating for the debtor when this happens, and there may be no good reason for it happening. If the debts have been sold, so an Assignment in Absolute has taken place, my best guess would be that it is linked to the end of the financial year approaching. Otherwise, sadly I think it's probably just one of those irritating things that can happen.

      Thanks for your quick reply so shall I ignore the DCA then and keep paying Lloyds and Monument direct then
      Both DCA state they are only collecting on their behalf

        I would. With any DCA who only has an Equitable Assignment I normally suggest ignoring their first one or two letters, then sending a 'Prove It' letter. The only time this changes, and it isn't relevant in your case, is where the OC is refusing a reasonable payment offer, as DCA's are much easier on the whole to negotiate with than OC's.
