    I was in a abusive relationship with my girlfriend. We have a current joint account. But the debt as been pasted on to capquest. Can i dispute this and have my name taken off the account. As she said she is will to take the debt on. Can we do that if her credit rating is bad

    Who is the account with?

    Do CQ claim to own the debt or are they trying to collect it for the bank?

    Is the money owing an overdraft or a loan?

      Hi the account is with lloydstsb and its overdraft on is £2028.14. And lloydstsb have passed it on to debt collection agency

          It just says that we have instructed CapQuest to arrange collection of the outstanding debt. We asked lloydstsb to take my name off. As my ex girlfriend said she would take on the debt. But as soon as they found out that she had a bad credit rate they said no. So thats why we have come to this

            i know hsbc wont take one name of a joint debt cant say if ltsb will after all 2 to go after for the money

              I fear that as long as it is owned by the bank, there is a joint liability for the debt and Lloyds TSB will refuse to release one of you from that liability.

              I'm interested to see where Kafka is going with his questions though - he is very knowledgeable.

                  General rule is that obligations under a contract cannot be transferred without the agreement of all contracting parties. So I would say not.

                  Perhaps if you and your girlfriend made a joint offer of repayment but just she paid ?
