  • Stat Barred Help Needed

    Hi,

    I have had mixed advice on another forum so thought I would try here and see if I can get any help on this matter.

    I had a company contact me recently regarding a debt they said I owed, I didn't even recoginise who the original creditor was so I sent them the stat barred letter, I used the template off National Debtline, however that debt letter doesn't include the line I do not admit this debt etc, which as I think I will find I will need later on.

    Anyway the company wrote back to me saying I made a payment on that debt in June 2007. I don't remember making any payment to them though. What I am trying to find out are what are more options from this point? Will I have to bite the bullet and pay this debt or is there anything further I can do?

    Additionally it's kind of a nightmare as I am applying for a DRO this week and this debt puts me right next to the 15K limit so any movement by any other creditor and I would be over the 15K limit.

    Have you confirmed via bank statements that you have that you made any payment for this debt?

      Its their job to provide proof that a) a debt exists, b) they are entitled to collect it and c) that you are the person responsible for paying it. Its not your job to prove that you don't. Even if they can prove that you paid in June 07 it would become SB in June this year, or it already is if you live in Scotland. Yourbest bet is to ignore them and play for time.

      It may help explain if you provide more details about this. Is it a DCA trying to collect it?

        Hi,

        many thanks for the reply. My bank statements show a lot of payments around that time, however back then I was using cheques for everything and all the payments to anyone are just down as cheque numbers and not actual information of who was paid

        I live in England, it's some company called Fenton Cooper and their 'client' is Arrow Global Limited.

        I was thinking about leaving it but wouldn't I have to declare it on a DRO? Or would I leave it out as its in 'dispute'?

          Definately demand written PROOF that YOU made the payment. According to the Leeds Losers I made a payment on a Bank Holiday another on when I wasnt even in the country.

          DCAs and the so called solicitors are pathological liars and will do anything to CONvince people into making payments

            Hi,

            Many thanks for replying, yes I do think I will ask for proof as the company they are saying I owe the money to dates back to 1999/2000 era!

            Out of interest does anyone know regarding my comments about the Debt Relief Order, I have my interview in a couple of days so should I leave this debt out as it's in 'dispute' ?
