Turns out solicitor got it wrong court date set for 5th Dec. Have been well and truly kippered. Have been forced into using an expert witness dictated by LMC who just happens to be an ex banker from Leumi bank. Instead of my independent expert from an actuary background. Needless to say the report is not inspiring given that it is based on an Equifax report that is not in my name has no date of birth includes an associate who I have never heard of and believes I use my wifes name as an alias.
You would think an expert is supposed to be unbiased and see through such dirty tricks but apparently not. How on earth I am expected to have a fair trial is beyond me.

Yes it looks legitimate as its an actual request for information and there is a telephone number and time stamp to say when the info was downloaded. Would be interested to find out whether this was the only request as I cannot believe a bank would request an equifax report without a date of birth especially when the equifax report they send back suggests the date of birth on a previous enquiry to Blemain Finance 12 months earlier.

Yes but the first step is to find out whether they have the equifax information legitimately, and then if that information is false whether it is down to Lancashire, or down to Equifax.

Could not care less about equifax or any of the other credit rating parasites. Would be a different matter if you could sue them for holding false information about you.
Yes Lancashire have provided a copy of the Equifax report they used back in 2007 which shows no date of birth, no confirmation on the electoral roll,no active accounts,no settled accounts, no defaults,no accounts opened in the last 6 months, Total outstanding balance of zero, worst status in last 24 months N/A. Telephone number match NO, Electoral Roll DOB match NO, Credit Information DOB match NO,

You really could not make it up.

Sorry to drag up an old thread but just going through the court documents provided by Lancashire Mortgage includes an Equifax report which is missing my full name or date of birth hence no record of any of my credit or bank accounts although it has pulled up all my wifes accounts as an associate. Most embarrassing is another woman on the account 6 months older than my wife who I have never heard of. I take it this is good ammunition.

Lancashire have provided you with a copy of your full credit report ?

That another person who you do not know of is on there is slightly concerning. Have you had a look at a credit report online service like Noddle ? You should be able to see on there why she is classed as associated and put in a request to have her removed, which is usually quite straight forward unless there are any live joint accounts.

negligence where the lender had failed to undertake proper checks into the borrowers’ financial position and
had failed to uncover a very poor credit history including a series of county court judgments. A deduction of
70% was made for contributory negligence.

In a speech in the House of Lords on 20 December 2005, Lord Goodhart QC expressed the view that 100% contributory
negligence was a logical impossibility on the basis the whole point of contributory negligence is that more than one party has
contributed to the damage. Lord Hunt disagreed with him, but one can certainly see Lord Goodhart’s point.

This dangerous company will pay back charges if challenged but you have to be strong and show them you mean bussiness.

I am a LMC (Same lot) victim-in 2013- I wrote to them and asked them to specifically provide a detailed account of all charges applied to my account over £50-miraculously thet suddenly refunded charges of almost £10,000 I suspect because of Monarch? It is definitely worth trying. Keep at them they are running scared at the moment.
