    Hi

    One other thing I've noticed is that the claim form shows Northampton as the court. We're in the South of England; I take it we can apply to have it moved nearer to us?

      It will be moved to your local court. Northampton is actually not a court at all, you wouldn't go there for a hearing, it's just the bulk processing centre for money claims.

            Hi again

            Just for anyone who's been watching, I've been talking with Celestine who has been helping me/holding my hand with this claim. I really can't thank you enough for picking this thread up!

            I've just put in the acknowledgement to defend in full (I missed that it said acknowledge within 14 days!) and am feeling much less stressed! OH is relaxing a little now too - I don't think he's slept for several days now what with this and his 96yo grandmother being admitted to hospital twice in the last 2 weeks. It doesn't help that he can't deal with this during the day as he's working, so he's obviously feeling like he's lumping it on me. Things never come one at a time do they?

            I'll update as and when anything happens.

                I can do the CCA (I'm fairly sure it's legitimate though), but I got the default info wrong, as in we don't have one.

                If it was sent, it would have been just before I started looking at forums for help, and before we knew to keep all paperwork. OH was dreadful for throwing things away, and I have a horrible feeling that this may have been chucked.

                That said, I also couldn't find any reference to it in the SAR notes we have. Admittedly I'm no expert, but I can't see anything that looks like a code for a DN being sent, or anything that relates to one. I thought they were meant to note down that one had been sent as proof? The notes do go back to the period it would have been issued (around '07), there just doesn't seem to be anything about a notice being sent. A default was registered on the credit report in July '07 though.

                As I mentioned in reply to PT's post, the only notice I can find for the 3 HBOS/BOS accounts OH has is for a different account that was defaulted a while later, and as such I have got that one (not that it helps here!). It is a woeful attempt though, giving one day to remedy!

                I take it there's no way to get a true copy of a default notice? Any time I've asked banks in the past I've been told it's just a generic document and all they'll send is a 'this is what it would have looked like' copy which is no good to anyone.

                With the CCA - I have one uploaded already but with personal details blocked out (name/address etc) which I could email to you straight away, but if you need it with all the personal bits I'll have to wait for OH to scan the original tomorrow at work as our scanner is out of action.

                      We (well Celestine!) have asked for more time and requested documents from Halifax, and it looks as though there may be a few issues with some of the paperwork OH has been sent, which could be a good thing for us.

                      I'll leave it at that for now, but Celestine, if you want to add anything please feel free! I'm just keeping it pared down as I don't know if it's ok to post ins and outs

                          You'd probably feel more comfortable in the VIP area which is not open to everyone.

                                Hello again!

                                Things are still ticking along with this (nothing to do with me, it's all Celestine et al), but I'm actually after clarification on PPI...

                                Celestine, I know I spoke to you about this the other day - I was going to go online and file with the bank regarding the PPI, but I just wanted to clarify if this was the right thing given that they did (2 1/2 years ago) give OH a final response saying they rejected it. Does this mean I should still go through the bank again with the same argument, that I should go to the FOS now, or is it too late for either?
