  • CCJ instalments?

    Have been asked by a friend if i know the answer to this?
    She has a CCJ where payments are £4 per month allright up to now bust as she is on benefits which are not rising and in april she will have to pay money towards her rent and council tax she intends to tell them she can no longer pay and will tell them she will pay a token £1 a month if they refuse she will tell them to take her back to the County Court and expects that the court will order her to pay only £1 or the £4 as now she will only pay £1She has no assets is disabled and all the stuff in her house belongs to her son as she lost everthing she owned the son will swear a declaration to this what would anyone advise and thoughts on his

    Tell her to take the bull by the horns and apply for a Variation Order herself. Form N245 from HMCTS website and easy to fill in, has I&E as well. Don't wait till the last minute.

      Be careful she doesn't shoot herself in the foot. The I&E is critical. On a low payment, she may just end up paying £1 more (the maximum they can currently take for one single debt from a person's benefits).
