Re: I need your help RE: Bristow and Sutor - council tax

The 2nd letter amalgamates all the fees that have been charged and include Attendance to levy Fees of £42-50 which tends to suggest they have made 2 visits previously - the ones alluded to by the Council on 13/02/12 & 03/04/12.

As for the levy, do you have a copy of the Notice of Seizure? I know you have mentioned items previously but it would be better if could either scan the Notice or copy it verbatim - listing everything exactly as described. The Header H Fee can be removed as unless he actually removed and you had paid he cannot charge this - there are LGO reports about this practice stating it should not be allowed. Although he may charge a levy fee & a Walking Possession Fee if it is signed he cannot charge his Van/Visit Fee at the same time.

It may be seeing as the Council appear to only speak Bailiff that you have to write a Formal Complaint to the Council CEO.

The first time when bailiff came to my house was 15.10.2012 (My wife let him in first time)
      He've never been here before.

Can he charge me first visit fee and second visit fee if he never came into my house?

As there appears to be a discrepancy on ates you are going have to ask them to provide proof of visits, particularly as they seem to claim they have been before this date. Just because you did not see or speak to them does not mean they have not been - although they are supposed to leave a letter detailing their visit. You can go no further until this is done.

          And nor should they!

            Hi

OK, I will ask them to prove it.

I'm living at my current address since August 2012.
That's mean I wasn't there when the bailiff came 1st and 2nd time.

The only one option is if the bailiff were looking for me at my previous address.
But between DEC 2011 and AUG 2012 I wasn't there.
I was living with my friend (marriage problems).

Can the bailiff charge me 1st and 2nd visit fee if he were looking for me at wrong address (not my current address)?

Do you know anything about this?

I resist the temptation to say, 'Yes!' lol

I have not revisited all the thread, but from what you post I assume you were liable for council tax at your matrimonial home, jointly with your wife. When you moved out, did you inform the council (or did your partner inform the council) you were no longer living there?
