    hi all after some advice. have stupidly been ignoring letters from mmf last week received an automated phone call threatening a visit so i rang the office to say id set up a payment plan. at the minute nothing is in place and they have no payment details for me. however today they rang my mobile off a number which i cant ring i then received a text again mentioning a house visit. is this just threats to try and get me to pay whats the best way to deal with this company?

    Firstly you should only communicate in writing. The worst thing you can do is talk to debt collectors on the phone. Those people are trained to intimidate and bully people into making payments they can't afford or shouldn't be making for whatever reason. There is also no guarantee that any agreement reached over the phone will be maintained. I know of an extreme case where a debtor set up a repayment plan over the phone and the creditor promised to freeze interest in 2000. The debtor stuck to the plan but the creditor kept added interest over the past 12 years and now the debtor has no way to prove interest was supposed to be frozen!

    This is an extreme case but makes a good example of why you shouldn't agree anything over the phone.

    Most threats of home visits are just that: empty threats. On the odd occasion people have received such visits but even then, field agents or doorstep collectors have no right to be in your property without an invitation from you, nor do you have any obligation to speak to them. They are not bailiffs and can't force you to make a payment.

    The best thing to do is to approach the company in writing by responding to the letters they have sent, making it clear you will only communicate in writing and not by text or over the phone.

    It would be useful to have a bit more information/history regarding this debt, what sort of debt is it, when you last paid, how much you owe them, etc.

      Motormouth have been threatening me with visits for monts. They have not appeared . Their threats are like their heads EMPTY.

      The only way to speak to a DCA is through a medium.

        Hi sorry for delay in replying am working very unsociable hours at the minute. It is wageday loan from wageday advance I owe around 400 on MMF have held the account since October. I was going to ask if there was a template letter I could send but I think I may have just found one on another thread but anything you can think of would be a huge help.

            There is a telephone harassment letter where you could add 'and texts' after 'calls' --> http://www.legalbeagles.info/forums/showthread.php?t=81 and state that you will only communicate in writing.

              The desperation is all theirs pal.. If you have an android phone its easy to block their threats. They are full of bovione excrement. They have been threatening me for months with all sorts and now in their latest admission that they have F All they have offered me a discount.

                thanks to both of you for your replies will definitly send that letter when i send the written correspondence only letter later today.

                border interesting you mention a discount they offered me one when i spoke to them last week think it was around 100 pound off and they could let me pay it over 2 months

                  I have just had this text msg from them - should I do anything is is this more scare tactics from them?
                  "Unless you call MMF in 5 days a Court Claim may be issued with any subsequent CCJ being enforced by Bailiffs or Attachment of Earnings on your employer. 01138 8"

                    That really is disgraceful, sending threats like that by txt! :mad2:

                    Firstly, if they were going to issue a claim they should send a LBA (LETTER Before action) or LETTER of Claim, not a text:
                    A Claimant must provide a letter of claim before he issues proceedings although the claimant can decide not to. If the Claimant fails to provide a letter of claim this can have adverse consequences for them. Normally most creditors will send a letter of claim in some form or another, its up to you to decide if the letter complies with the pre action protocol and more importantly its your obligation to reply to it.
                    Also they're jumping the gun by mentioning bailiffs and attachments of earnings, first they will have to take you to court, and you would have the opportunity to defend or settle at that point. They'd have to win and obtain a CCJ, which would be an order to pay a certain amount every month. You would have to fail to keep up repayments on the CCJ and they would have to go back to the court to apply to enforce via the methods described, so they are really miles away from obtaining an attachment of earnings or sending bailiffs round! :rant::rant::rant:

                      They would also have to pay fees for the CCJ paperwork and then £100 for an attacment to earnings order cannot s them paying money with no guarantee of getting it back its a threat probably with no action be advised by those on this forum in the know.Not me im afraid the others are more knowlegable than me

                        Ive had the same silly text from this shower of ****. One of them was hilarious in that it said they would use the text in a court case to determine costs. What planet are they on. Despite all their threats of visit, court etc nothing has happened. Cupid Stunts

                          Just to add my input here, I had the same problem with motormile since October,the texts the calls the emails all threatening visits even after I agreed on one of their payment plan offers. I came on here and found a letter template known as a WOIRA or "withdrawal of implied right of access", which basically states that you do not allow these people to come onto your property. It also states in the letter that they should communicate with you via mail only and no more calls and texts etc. send it recorded delivery so you have proof they received it, once they received mine the calls and texts etc all stopped.
