    thank you very much labman i must say this forum has really relaxed my mind as i was panicking

      that because i have made payments during the recent year are lowells legally alowed to chase me again

        Just remember that a DCA cannot force you to pay more than you can reasonably or realistically afford. If they do, they are in breach of OFT regulations and their OFT Licence. The OFT do not take kindly to DCAs behaving in the manner they are in your case.

          They can chase, but you are not under any obligation to pay a penny. BB has misread in the post above, and hasn't twigged the debt is SB I think. Once the debt has not been acknowledged or any payment made towards it for a continuous period of 6 years it becomes SB, and as far as a CCJ goes, they have to go back to court to apply to enforce it again.

          Once SB it never becomes un-SB'd, it can't be done! The debt exists, so they can ask you to pay, but you have every right to invite them to go forth and multiply.

            Thanks for pointing out about the SB, Labman. TBH, I hadn't twigged. Thank you.

            Labman's advice is excellent, as always. Use the weapon of a court injunction as a measure of last resort and only if Lowells et all start getting really silly. You might want to consider an Unless Order as well in such circumstances.

                lowells are AT IT AGAIN
                my girlfriend checked her credit rating and to her amazment lowells had checked her out 4 times (she has NO debt whatsoever) i think its due to my issues with them as the trading stanards are still looking into them

                these guys are crooks in my opinion

                  She should send a letter to Lowells asking why they are checking her CRF when she has no credit with them. They could well be in breach of the DPA here and so you could complain to the ICo. The ICO would almost certainly expect you to follow Lowell's own Complaints Procedure first though in this case.
