  • Spampocket Court Claim

    Hi all I'm new to this but saw this post I'm after help really. I received a court claim form from Northampton county court in relation to hegarty LLP. I'm accepting the debt as personal circumstances changed and couldn't pay my debt so now I'm in this rut. Going back to the form I'm not sure what to do as I do not have any income I do not work as I look after my two small kids fulltime. I don't receive any benefits as they say I'm not allowed because my girlfriend whom I live with earns too much. But where it says to state my income and expenses what do I put coz it states for me not to put anybody else's finances in other than my own. I have wrote a cover letter explaining my situation ie no money myself but I can offer maybe ten pound a month from borrowing from family to pay them. Do you think that is ok the full debt is 7k including court and solicitor costs and interest. Any advice regarding what I need to complete on the expenses part of the form. Thanks I'm really scared they won't accept my offer and either get bailiffs in or send me to prison.

      The problem with an I&E like yours is that thye will see a lot that is missing and wonder how you live. For example everyone needs food, energy & housing. If you have no income of your own that covers this as it is paid by AN Other it is better to put this in as income then also pay it out as expenditure - as long as the 2 match there should not be a problem.

        Thanks for the thread and thanks for the reply, I did telephone hegarty yesterday but office was closed till the 3rd of Jan. In the meantime I had to send the form back in the post recorded delivery otherwise id miss the deadline just hope they don't play funny buggers and say my offer of repayment is not acceptable. I think though if they did dispute it and ask for a judge to see if its a reasonable amount to pay I shouldn't see him saying that's its not if it is I'm done coz I can't afford anymore can't afford ten pound but I'd find it from somewhere.

          What forms are you having to fill in and who are you sending them back to?

          You say initially you have had a "claim" form - is this just the original N1 where they are claiming you owe a sum of money?

            if you do not have any income, maybe you have benefits?

            How do you live and get by day to day?

Please do not send it to the courts at this time just do it so that we can help you further.

            If the full debt is £7k they could bankrupt you so please be careful about borrowing money at this stage.

            Do you agree that you owe this £7k and who actually filed the claim against you was it the person that you owe money to?

              The recommended advice for debt advisers in your circumstances is to do as Ploddertom has suggested. My wife is in the same position - as I 'earn' too much, she is not allowed to claim any benefits in her own right, so relies on me for finances.

              If they don't accept your offer, then I would suggest you get a full Common Financial Statement completed by a licensed debt adviser, and apply for a Variation to the Judgment using Form N245. Wait and see what they come back with first re your offer and the I&E already submitted.

                I just have a question about this thread.. I know when my parter was unemployed for a little while he couldnt claim after a short while because of my earnings. Why would it make sense for them to make you bankrupt when it costs them money to do that?

                    As it costs someone to make another bankrupt,i think the fees are 700 quid?
                    if you bankrupt someone with no assets or money like me say you would be spending your money for my good ?
                    Im waiting for it to happen to e bet its a long wait

                      Thanks waless01man, see my point, it makes no sense, to spend another £700.. seems vindictive really and they lose even more money!
