    Hi all
    Sent a letter to Barclaycard asking if my account was equitable assignment or absolute has Lowels were hassling me but got a reply from Lowel saying Barclays had passed the letter to them and in response the account was sold to them on xxxx
    Is it up to Barclays to play ball dont trust Lowell and still no wiser if its equitable or fully assigned
    forgot to add I did have PPI with this one

      Have you CCA'd Lowells yet? Also, apologies if I should know, but how old is the debt?

        Do you wanna do PPI with this ?

        It should reduce - or even wipe out - the debt.

          Hi Labman
          Its about 12 years old used to be Littlewoods then bought by Barclays, not sure if you remember but you asked me to write to Barclays and ask if the account was equitable or fully assigned
          Just wondered why Barclays did not say and I have Lowel writing again giving me information instead when its hard to know what the account status is as we all know they cant tell the truth
          Sorry for got to add I didn`t CCA them for this account but they sent an application form stating it was a CCA for another account I was querying which actually applies to this account if that makes sense

            Yes I would like to do PPI with this but I dont know how long I paid it in my moments of madness I did not keep any statements only thing I have is a letter recommending using my PPI when I was first having problems paying

              Winner, I apologise sincerely for my almost total lack of memory. Let me get this right - this debt was originally with Littlewoods (Shop Direct)? Then Barclays bought it (I have never heard of Barclays buying a debt before)? Then Barclays sold it to Lowells?

              If the above is right you need to CCA them, and I apologise fornot saying this in the first place - I'll send you the letter you need to use, just nag me and pm me until I do, as by the time I return home in an hour or so I'll have forgotten I wrote this.

                For a PPI claim, we need to know who was responsible for mis-selling the PPI - either Littlewoods or Barclaycard. I am guessing that this was a Littlewoods account, which you settled by using your Barclaycard to pay it off - please correct me if I'm wrong.

                If Littlewoods were charging PPI on the account, then you could reclaim the PPI from that, but if you have no records, then you would have to ask Littlewoods for copies of statements. You could send them a Data Subject Access Request (DSAR), which costs £10, but you will probably not get any data which is older than 6 years, so this may not be worth doing.

                If my guess is correct, and the account was paid using Barclaycard, then a PPI reclaim from Barclaycard would probably be more likely to get a result - assuming that you were being charged PPI on the Barclaycard account. A DSAR to Barclaycard would definitely be worth considering in this case. I usually recommend getting the DSAR data back before sending a claim, but if you're sure you were charged for PPI and you want to get this resolved quickly, then send a claim to Barclaycard ASAP. I always recommend a non-specific initial claim letter - you might find the attached example useful - just alter it to suit your circumstances - or use bits of it as you wish.
