      Please post up what you can as it progresses because it will help others in the same situation. There are 2.5 million of these credit card accounts apparently. What makes me angry is that M & S know the legal position but they are still issuing court summons in the hope that the average consumer in debt doesn't know it or is too frightened to challenge them in court. I'm doing my best to spread the word :director:

        I've gone back through your thread and I can see it wasn't an 'unsolicited credit token' (i.e. uninvited credit card) so you've got a different defence (my mistake ). Nevertheless I look forward to following your legal arguments on this one :nerd:

        I remember John Lewis went through a phase of pressure selling whenever I presented my storecard at the till for a purchase. It was the same deal as M & S which was a discount if you signed up on the spot, but since there was always a queue of people behind me waiting to pay I didn't want to be a pain so declined. But there was clearly no time to give those people who did fill in the form any Ts & Cs to read and understand. I complained to John Lewis at the time and they admitted that the staff got paid commission for each one signed up. I expect M & S did the same

          I will of course give a full account when as things transpire at this stage I am putting in an amended defence as they failed to provide the documentation to support their case under my CPR request. It's expected the court will decide they will have to meet the cost of the amendment.

            So I should think !

            Also keep a list of all the time and effort you have put in on this case as a LIP before you instructed solicitors. I was advised that I could claim this (£18 per hour) when I got a costs order so I hope you will be able to do that too. But let's not get ahead of ourselves yet :beagle:
