            So do you know when the account went live ?

            Post 76 above has a section on the document that refers to 2006 and another that refers to between may 2005 and may 2006 so there is no way they are the original terms (you said 2004 right ?)

              Seems to me your photo gallery starts with letter etc then current terms and the final 3 pages are the original terms ? Does this sound correct ?


              Also when did you get what and are there any cover letters etc not in your photo gallery ?

              Off to bed now but should be around for pretty much all day tomorrow.

                All I can say is there is from my point of view there were definatley no original terms. It was originally a MORE credit card and then changed to a M&S one so I can only assume the 2 page conditions were applicable to the MORE card and the 4 page version applicable to the later M&S card.

                  When the more credit card changed to M&S was it just a rebrand or did the card terms change in any way ?

                    Have you seen this thread? This post also refers to an M&S application form not having all the prescribed terms at the time of signing it so it looks like that happens quite often. ---> http://www.legalbeagles.info/forums/...248#post311248

                      to the best of my knowledge it was just a rebranding as i never signed another agreement/ application.

                        Hi Fp yes i do know that one its my daughter trying to help me out. No it was not a storecard as I had one of those when they offered me a discount when I was in the shop to sign the application for the MORE card..

                          e.g. sent s78 01/01/01 got application form and statement sent another s78 01/01/02 got application form and some other terms etc etc


                          What did you get in store when you signed up ? (what you didn't get i'm not so interested in yet)

                            I did S78 in 2009 they spent 2 years telling me they could not respond unless I signed my letters. Eventually they gave up that nonsense and complied with the copy of the application/agreement you have seen along with the two different sets of terms and conditions plus the sheet headed "statement of transactions which just shows a balance owed figure and showing no transactions.


                            What did you get in store when you signed up ? (what you didn't get i'm not so interested in yet)

                            I got one sheet of paper which was printed on one side only ( I believe that came from a NO Carbon Required set of forms) that is the application form as you see it.

                                I know for sure the 2 page conditions came with the s78 request and believe the 4 page conditions could have been included also but they could have come at another time.
