  • Stat Barred Debt!!!! please help!!!

    Hi, I have been trying to find out some info re stat barred debt but so far no luck so I'm wondering if you would be able to help please? I have read that under the Limitations Act 1980 any debt where there has been no contact for 6 years or more is stat barred and un enforecable. Please can you clarify what no contact means, is it no written conformation or part payment from myself or does me receiving a letter from my debtor count?


    Clarification would be muchly appreciated

    it is acknowledge the debt either by letter or payment to the creditor that counts

    the statute of limitations start from the cause of action, not the default date. that would be from when the last contractual monthly payment was missed to the original creditor

    they can send a thousend letters if they want, it is you responding in writing or payment that counts

      welcome to LB if you havent already been welcomed.

      No a letter from your creditors doesnt count at all. No contact means you have not contacted them up and said Yes the debt is mine, can i pay x per month to clear the balance, or made payment towards it.
      They can write to you and say they want the money but there is absolutely nothing that they can do about actually getting it. They cannot take you to court, send bailiffs or visit your home.

      Letters about stat barred debts are best filed under S for shred it!

            Thanks for the info. The debt is not yet stat barred I have been paying several banks for several years but due to difficult circumstances I have not paid in approx 12 months. These are all unsecured debts, I assume that they can take me to court and I can receive a CCJ? If this happens does this stay on my CRF until the debt is paid or until the debt is classed as stat barred?
