        Have tried mate, but when i click upload the browser screen goes blank so its not letting me upload them! Have emailed them to Mrs G for her to have a go, hopefully she has better luck then i did.

        I didn't send .pdf files i sent a zip file containing images, try opening them in paint, making sure you unzip the zip file first by saving it to your desktop, right clicking it and click extract.

            Right sorry i not back on again last nite, i had a pool night and yes we kicked arse lol. Anyway i have reemailed them to you Mrs G but this time i haven't bothered to put them in a zip file so you can downlond each one from the email seperately. Not sure why you weren't able to open the Zip file last time.

              I have just been reading through some of MMF'S letters , the first one was dated 27/6/12 and says that i have not responded to their previous letter giving me notice of Legal assignment of this debt to MMF UK LTD from British Credit Trust.

              I never revieved that letter from them , and the next one that came dated 19/7/12 was the formal letter of assignment . One from them and the other from Gothia original creditor BCT.

              It says we hereby give you formal notice that the debt was assigned to them as of 21/5/12 , and that they are the legal owners.It looks like it has taken them nearly two months to tell me this.

              After Barry emailing me an unclear copy of the finance agrement , i have heard nothing from them. Which by the way has both of our signatures of as Customer 1 & 2 , if we both signed for it like that .Why are they so keen to hound me for the money instead of going after my Husband.

                Agreed the debt would be 50/50 not 100% yours! Just ignore from now on as the agreement looked uenforcable to me!

                        Has anybody had any contact with MMF recently , apart from the email containing the credit agreement on 26 November . I have heard nothing since , they seem to have gone rather quiet.

                            Hi, sorry but i do not agree at all.

                            First point of order, it is only unenforceable when a County Court rules such. Until then, an open mind must be maintained.

                            Secondly, while an agreement must be "easily legible" when provided under the CCA 1974 ( see Regulation 2 Consumer Credit Cancellation Notices and Copies of Documents Regulations 1983) so to comply say with s77(1) CCA 1974 an easily legible doc should be provided, given the age of the agreement it is unlikely this creditor will have any problems in reconstituting to discharge any s77 burden. I assume there is not an argument that the agreement wasnt easily legible when it was signed? if there is, then thats a dodo from the start as you would be a mcmuffin to sign something you cant read.

                            Turning to the argument about two separate agreements? on what basis could this be the case?

                            S141(5) CCA is clear on the requirement of "ALL" parties to a regulated agreement to be made parties to proceedings, on that basis, it would be absurd if a person could not jointly sign a credit agreement. Unless i have missed the point of course.

                            It is clear to me that this is a single agreement with two debtors entering into credit under a hire purchase agreement.

                            One must also ask what if the agreement is UE? well the car never becomes your property under HP, so title to the vehicle never passes, but the car would need to be returned at the end of the contract none the less.

                            I do not want to give false hopes here, and in my view, the agreement would be enforced by the Court if the Claimant were to overcome the legibility issues
