things start to get interesting now, i will hold barry to every statutory obligation going, mmf likes to send out reams of threatograms, he has seen nothing yet for lawful requests on their rights to chase you for this alleged debt

they will get sick of your requests by the time i have finished with them, all which they have to comply as they have a legal obligation to

boot on other foot now for mmf

and the account will be on hold until they do comply

that will hold them off long enough until the OFT close them down

tboy2 has allready been through this, no doubt he/she will pop in later
        Oh yesss lol

They originally sent me 2 agreements for 1 loan with 1 dated for 1 month and the other dated for the following month, surely i would have only ever signed one agreement not 2 even if i had taken out the loan.

Anyway i request them to send me legally certified copies of the true copy of the agreement, default notices and deed of assignment along with a formal cease and desist which included the removal of the default from my credit file. Which was actually removed and no legally certified documents arrived. Though they did try it on again by email earlier last week, but soon got shot down again lol.

How long do MMF usually take to get back to you , when you have started to ask for copies of credit agreements .

Or is this when it starts to get nasty,i say bring it on and i'm ready for them . They can't be any nastier than my husband and i'm starting to get the better of him .

He's not so Smug now the CSA are after him Lol.

Truth be told, they normally dont!

I believe if you do a SAR request (which has a fee of £10) takes up to 40 days, I believe the search you asked for has the same time scale, keep a check i the £1 has been cashed.

Hope you made it clear that was what the fee was for, its been known (and from personal experiance with another DCA) for them to pay it into the disputed account.

                          Re: Mrs G's MMF Problem

Right, well for a start its two seperate agreements, both for the same amount one under MRs G's name and 1 under Mr G's name. A lot is not legitable so that makes it unenforceable but it is borderline readable.

But the same set of terms and conditions showing both MRs and MR G's names. By my reckoning i would say its unenforcable as i've never heard a agreement could be made in such a manner, only that it can be signed by 1 person and a 3rd party would be a gaurantor. i will eremove identifiable info from it and post it up for others to look at and give an opinion on it.

Thats if thats ok with you Mrs G?
