    Re: Mrs G's MMF Problem

Ideally i would love to have to pay the, but i don't know if that is possible . They told me they also have my husband's signature on the form, so why are they chasing just me with their threats of what they will do to me . If it went to court how much would the Judge say , i would have to pay them , all i get if £71.40 and if they think they will get £10 per week of that they are mistaken .. Any help or hints would be most Welcome , even if it makes them wait for the money.

That letter came this morning , not in the normal MMF envelope And it looked like the address had been written by a Todler . I don't have a scanner or i would have put it up , for all to see .

              Re: Mrs G's MMF Problem

What I would suggest is an email with the following, or maybe if my friends would care to edit it t improve go ahead.

              Dear Barry,

              Re your letter dated xx/xx/xx

With regards to this account, please provide proof of my liability to pay this debt.

              Acceptable forms of evidence are

Hard copy of the original HP agreement bearing my signature.

please note this is not an SAR request therefore no payment is due to you.

ALSO please note that under the OFT's guidelines the following are seen as unfair practises

. ignoring and/or disregarding claims that debts have been settled
or are disputed and continuing to make demands for payment
without providing clear justification and/or evidence as to why
              the claims are not valid

when a debt is reasonably queried or disputed, failing to
investigate and/or provide details (possibly including, for
example, details of account history, payment schedules and
relevant correspondence) to the debtor, as appropriate, in a
              timely manner or at all

              I await said paperwork

              yours

              Mrs G.

              DO NOT SIGN IT!!!!

              Print or type your name.

and never sign any letters with your normal signature - they have a habit of copying them

                      right then

this is what i want you to do

send barry an email as to where you can send him a formal request for a copy of the credit agreement they rely on

tel him it will be a section 77 to section 79 request under the consumer credit act 1974 with a one pound postal order. and that all activity on the alleged account is to cease until they have complied with that request

                      send the request by email

send the request by email for the address where you can post the s.77 to s.79 request to and never sign, print your name

                          Re: Mrs G's MMF Problem

post up as soon as you get a reply

things start to get interesting now, i will hold barry to every statutory obligation going, mmf likes to send out reams of threatograms, he has seen nothing yet for lawful requests on their rights to chase you for this alleged debt

they will get sick of your requests by the time i have finished with them, all which they have to comply as they have a legal obligation to

boot on other foot now for mmf

and the account will be on hold until they do comply

that will hold them off long enough until the OFT close them down

tboy2 has allready been through this, no doubt he/she will pop in later

Has anybody on here ever had MMF turn up at their door ? , i don't know if i have mentioned that the letter i recieved last Monday was hand delivered about 1.15.

Lucky for them they missed catching me at home, another question if they did come out and try to sieze my property . Can they try and take my Daughter's car in payment of what i owe.

                              please please

no they cant take your property, the only time that can happen is if its been to court, they get a ccj, and you fail to make minimum payments by the court.

i have had over 12 months of their threatograms, and they have still yet to pay me a visit

if they do turn up just tell them you revoke their right of implied access under a civil tort of trespass and close the door

you may start getting letters from a company called northern debt recovery and marshall hoars baliffs

marshall hoars is a virtual baliffs, only exists in the never never land of the internet, they have no baliffis, its just a company name, thats all, no staff

please stop panicking as thats what these letters are designed to do, they are only fit for hampster bedding, that all

                                Re: Mrs G's MMF Problem

ok babes, lets put your mind at rest a little.

MMF are a debt collector, if anyone turned up on your door (which is very unlikely) to quote my dear friend Clever Clogs, ask them have they brought their JCB to collect the doorstep.

A debt collector cannot and I repeat CANNOT sieze property or insist upon coming inside. They cannot put a levy on anything as they are NOT (despite what they say) certified bailiffs.

They cannot have the police called to force entry, they cannot have you arrested, or have the kids taken away.

The worst they can do is take a photo of your house to add to a "I got told to chuff off here too" album, and no.. them taking a photo of your house does NOT mean they can take your house away.

They are bullies of the worst kind, and as such need dealing with as scum. If they DO turn up at your house, take a nice photo of them and say I am now closing the door, calling the OFT regarding harrasment, I revoke my permission for you to call at my home and if you are not off my property in 30 seconds, the police to have you removed. and shut the door in their faces. DONT get in to a conversation with them just come away from the door.

                                EDIT:

Cross posts Militant, we must stop meeting like this.. people will talk :tinysmile_aha_t:
