  • JBW Notice of attendance (parking fine).

    1st i should say hi as just signed up on the hope i can get some advice after reading through pretty much the whole fourm.


    A notice of attendance was popped through my door at 6am this morning for a unpaid parking fine from camden council which totals @ £283....there is a breakdown but its printed out of order so not sure what sum refers to what!

    Now,my financial situation like many these days means there`s no chance in hell i can pay the full amount in one as they`re asking for. Now,should i call them and try to make a offer of x amount per week,or is there any other avenue i can go down?

    Thanks in advance for any advice given as a tad stresed right now.

    Well, firstly, were you ever notified in the first place before it got to this stage that you actually had a parking fine?

      I guess i was yes,i`ve been exceedingly stupid over this as i`ve not opened the letters so allowing it to get to this point (there are reasons,but it`s no excuse/defence). I know that`s a stupid thing to do,but as it`s now at this point would it be best to call them and try make a arrangement to pay a sum per week?

        Could you post which local authority is involved and what fees JBW is seeking, please? JBW are well-known for charging fees the law says they are not entitled to charged. They are also known for seizing goods they are not permitted to seize.

          London Borough of Camden,reading the out of line print i think it breaks down as.....

          balance before today`s visit £215.44
          attendance to levy fee £68.07
          attendance to remove fee £0.00
          total balance now due £283.51

          .....Also,as i`m at home scouring here and the net for ways to pay this within my budget,i`ll be needing to leave for work soon.....will any attendance happen while i`m out do you think? Or will i have a few days to respond to the letter or should i call before end of work today?

            Okay. The fees are correct, which makes a change for JBW. The £215.44 includes £13.44 for the letter, which means the PCN + Court Fee is £202. The Attendance to Levy Fee is okay at £68.07. Either Jamie Waller, the MD of JBW Group, has had to kick his bailiffs' backsides over dodgy charges or, possibly, JBW Group has received a formal warning from a local authority, or a law enforcement or regulatory agency about it.

            JBW Group holds an OFT Debt Collection Licence and must abide by the terms of this licence, as well as OFT Debt Collection Guidelines, which means they must not put you in a position of paying more than you can afford or a precarious financial position as a result of their actions.

            At the moment, JBW Group are playing things to the letter of the law, but this not not mean that one of their brainless bailiffs won't behave like a muppet. Try and work out a payment plan you can afford and put it to JBW Group, making it clear this is what you can realistically afford. Include an I & E breakdown to support this. If JBW Group start behaving like muppets, that is when you may need to approach Jamie Waller and remind him that you have the right to bring the conduct of his company to the attention of OFT Credit Fitness Team, who have the power to revoke his company's Debt Collection Licence.

                as stated, I know nothing on bailiff law but can they charge an attendance fee to levy when no levy has taken place

                  Not sure if this adds anything,but the letter was just posted through the letterbox around 6am this morning without knocking,also the envelope it came in has no time/date/bailiff reference written on it.

                    Absolutely. Then they cannot argue about it. Bailiffs, unfortunately, have selective memories.

                      If JBW come asking for a Visit Fee, tell them to go whistle. I would not be surprised if they used an uncertificated person to push the letter through the door. If they have, they'll find it hard to justify a Visit Fee. When you write, ask them to identify the person who pushed the letter through the door. The fact they did not date, time and sign the letter they pushed through your door isn't going to help them.

                        Can`t thank you enough bluebottle! The letter itself does have a signature on it (tho no printed name,could be from mickey mouse for all i know!) but the envelope has nothing at all.

                        Does there happen to be a template for this kind of letter,or should i figure one out and post here for it to be given the once over?

                          It probably was from one Mickey Mouse and Goofy was outside in the van.

                          Unless JBW can prove a certificated bailiff delivered the letter you received today, they are on a sticky wicket. It is common practice for certificated bailiff companies to use an uncertificated person to deliver these letters, but it is strictly not on for them to do this as it must be a certificated bailiff who attends in order to legitimately charge the Attendance Fee. This is the reason they deliver these letters very early in the morning or very late at night. They rely on the fact you are not going to be up to challenge them. Some people have caught them and the bailiff firm they work for has had some explaining to do over the fees they have charged.

                          When you send your proposals for payment to them, make a point of asking them to confirm the name of the person who pushed the letter through your door and what job they do. Check the name given with the MoJ Certificated Bailiff Register or I have extracted the names of JBW's bailiffs and can provide you with a yay or nay fairly quickly.

                            I refer to the piece of paper bearing your company's details that was pushed through my letterbox at 6.00 am today.

                            At present, I am on a limited income and can only realistically afford to pay £xx.xx per week. I enclose an Income and Expenditure breakdown to substantiate this. I consider this to be a fair and reasonable offer of payment.

                            I am aware that your company holds a Category F Debt Collection Licence, issued by the OFT, and is required to comply with OFT Debt Collection Guidelines as well as the Enforcement of Road Traffic Debts (Certificated Bailiffs) Regulations 1993-2003, Enforcement of Road Traffic Debts (Certificated Bailiffs) Order 1993 and Distress for Rent Rules 1988.

                            I am willing to pay the PCN and legitimate fees only at a rate I can realistically afford and would therefore be grateful if you would accept my payments proposals.

                            For my records, would you please provide me with the name of the person who pushed the piece of paper through my letterbox this morning as they did not knock on the door and had gone before I could answer the door.

                            Reminding them of their OFT Licence and OFT Debt Collection Guidelines puts them on notice that you could make a complaint to a regulator who could cause their business a lot of damage. The loss of an OFT Debt Collection Licence to a bailiff company can put any public debt contracts they hold at risk and stop them collecting any non-public debt they may also collect.

                              Formatting letter as i`m reading your reply. I see they have 2 addresses (registered office and a PO box one) which would be the one to send to? Other 1/2 just got back from work and said she was up this morning when they popped the letter through so it would have been plainly obvious that someone was up.
                              Shall be doing the Income and Expenditure breakdown through dinner with the O/H and getting the letter in the post 1st thing tomorrow.
