  • A reply, at last !!

    After sending 4 recorded delivery letters over the past months and getting no response I finally told the DCA that the matter was closed as far as I was concerned and they didn't need to write to me now (bit cheeky I know). But lo and behold along comes a letter with 3 other 'copy' letters attached, with an old address at the top. 'We are sorry we seem to have had an old address' (funny really because I left that address before the DCA took over alleged debt).

    Also attached however is an illegible copy of an agreement, but no T & C, something that is supposed to be a deed of assignment but which in fact makes no reference to my account, or any account in fact. and there are obvious pages missing from this.

    So, what is my next action ?

    Write back and ask for a legible copy of an agreement, the terms and conditions, statement of account and a deed of assignment that proves my account has been assigned by the OC...and ask for the 'type' of assignment (ie are rights and duties included) ? Anything else ?

    Is this the right thing to do, or do I just sit tight and wait for them to write again ?

    As they have failed to comply with your previous requests there really is nothing further to say to them..

      Thanks curlyben, it's always a temptation to tell them because you have the feeling they don't know what they are doing, so don't realise they haven't complied. I presume if they threatened to take me to court it would be kicked out for non compliance with the CCA, that's assuming they have the 'rights and duties' ?

        See what they can be bothered to send you next and go from there.
        Should they continue making demands and threatening action then you'll need to point out all their failings, ie Your carp and I know it
