    First off, thanks to any help or advice anyone gives me, I really appreciate it guys.

    Well basically, about 7 years ago, I'm not sure exactly when because I now know the debt was taken out by my father in my name without my knowledge until I discovered it a few years later, a debt for a little over £900 was made on a Capital One credit card.

    Now I had no idea this Credit card existed, sadly my Dad kept this from me as well as a bunch of other stuff and for personal reasons, I don't really want to take him to court on this. To be honest I'm not even sure if I can. About 5, maybe 6 years ago I discovered the debt when I received a letter from Capital One informing me of the debt, I then dismissed it as not being real, as I hadn't taken out a credit card, and went on with my life.

    About 2 years ago I started receiving letters from Lowell trying to get me to pay. I ignored these as well, but did have some phone calls where I mistakenly admitted who I was on the phone, though I still didn't admit the debt or make any payments.

    From what I understand, this debt is out of date and under the limitations act of 1980, it should be statute barred. I'd like to ask if this is correct? If so, how do I proceed? Hamptons are threatening legal action including a CCJ or having the debt taken out of my wages as well as incurring interest and legal fees on top of the debt. Really, this would break me. I don't really make much money as it is and can't afford to make payments like these. I'm tempted just to offer some kind of settlement that results in me paying a small amount each month that's affordable, but wanted advice first.

    Thanks again for any advice you guys give. I'm a little nervous about this.

    Welcome to the site and the joys of the Leeds Losers

    Hamptons Legal, as well as Red Debt, are all part of the same Lowells, so nowt to worry about there.
    Now lets see what we can see..

    Have you made any sort of payment or contact with Lowell or Capital One about this debt ?

      If you didn't know the credit card had been taken out in your name without your knowledge until recently, the Leeds Losers would be very ill-advised to even think about threatening to take you to court, let alone take you to court.

      You are not liable for the debt, despite what the Leeds Losers say. I am a retired policeman and I know that this sounds terrible, but you may have to report your father to the police. Not only has he fraudulently obtained credit, it is very likely he has also fraudulently obtained goods and services.

      Don't offer the Leeds Losers a penny.

        I have to disagree with Bluebottle on this one. I would not report your father. You will find that the debt is more than likely Statute Barred and even if it isn't neither Capone or The Leeds Losers will have any legal paperwork to back it up.

        It would be a poor thing if at this stage you were responsible for giving either Lowells or the local constabulary evidence that would lead to prosecution. At the end of the day can you actually prove beyond reasonable doubt that it was your father who actually applied for the card in your name.

        I do not normally condone law breaking but sometimes it pays to look at the broad picture.

        Bluebottle, this is not a personal dig at a fellow retired officer but sometimes discretion is theest course and it's not as if DCAs like the Leeds Losrs are the most reputable people or pillars of society.
