    hi every1 x bin a while since i was last on here x my last request was on a company called wescott who say i owe a debt of £603?? having wrote to them requesting proof of this debt twice they seemed to have stopped x now they have transferred the so called debt to a company called resolvecall x now at first i ignored this letter but now having returned home this morning they have sent round what i can only see as a debt collector who pushed a note through the door saying this is the 1st visit regarding my account x i do not have an account with them and have never spoken to them x please help me this is driving me insane!

    From information I've seen on LB so far I'd personally not even speak to the agent that called and do exactly what you did in the first instance with Wescott and request that Resolvecall supply you with relevent proof of said debt. This is just something that I'd do personally however, I'm pretty sure though that there are plenty of others on LB that will be able to provide you with greater and more in depth information on how to deal with these people. Hope you manage to get it resolved though.

      hi guys x as you can see from the above date its bin a while since I asked for advice regarding the company called wescott, well I have received a letter at the weekend from rossendales basically threatening me with further action with the above said debt, how many more prove it letters do I have to write in order for these people to leave me alone? obviously Westcott have now passed the said debt to rossendales which make them the fourth, anyway they are threatening to pursue and utilise their expertise regarding collection of this debt, what should I do? xx

        Rossendales are both bailiffs and debt collectors, they use the fact they are well known as bailiffs to scare people into thinking they are dealing with a bailiff rather than a debt collector. :rant: :rant:

        If they are threatening to send someone round to your home you could send them the letter below, alternatively keep a copy of the letter handy in case someone does turn up, as I noted above you once had a doorstep visit. Most are empty threats but even when they do turn up, they have no more rights than your neighbour's cat! :thumb

        Account No/Reference No: xyz

        Please be advised that I will only communicate with you in writing. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

        There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.
