    Hiya

    I have been silent but have used loads of information off here which I would like to thank you all for...without it I would be really stuck...more stuck than I am lol

    Connaught have sent me a sd...sent them sar letter ...they responded saying they will do nothing to claim the money Back until they have th info I want...yeh yeh

    Also sent cca letter to bank

    I have wrote my statement etc and sent it to court to have this sd set aside...court have given me a date in a few weeks

    Whilst doing this bank have sent me a statement..well it statute barred..send stat bar letter to connaughtt

    1. How do I get this evidence to the court....
    IM sending statute barred letter to Connaught

    2. How do I sort costs out that I have incurred as I have spent forever doing this..and will loose 2 days holiday...what a waste..

    3. When and how do I submit costs to courts

    4. Who do I now complain to about Connaught...disgusting sending sd papers without proof

      if you have put inn the set aside application allready and been given a court date, you can send in any further information by doing a witness statement

      SEND A COPY TOP CONNAUGHT AS WELL AS THE COURT

      and enclose the letter about being statute barred also

        Rate Claimed Litigant in Person rate of £18.00 / hour
        Travelling Costs HMRC Approved Mileage Rate of 40p / mile

        1) Time spent identifying and understanding relevant legislation.
        Time spent identifying and understanding relevant case law.
        Time spent preparing affidavit and skeleton argument.

        18 hours @ £18.00 PER HOUR

        2) Time spent communicating with Respondant and swearing affadavit

        2 hours @ £18.00 PER HOUR

        3) Loss of day’s wages for attending court on xxx October 2012 £ XX.XX

        4) Travelling costs for return journey to court 2 x XYZ miles £ XX.XX

        Total £ XXX.XX

        Notes

        Before undertaking this myself I approached a solicitor to handle this.I was given an estimate of 3 to 6 hours at £170/hour to prepare the Application(£510-£1020) plus extra for attending the court.

        I respectfully request that the court give consideration to awardingthese costs on the indemnity basis or, in the alternative, on the standardbasis as I believe, in any case, that they have been proportionately andreasonably incurred and/or are of a proportionate and reasonable amount.

        In support of this request, I would also like to refer the court’sattention to the authority of the High Court in the case of:-

        Hammonds (a firm) v Pro-Fit USA Ltd [2007] EWHC 1998 (Ch)

        In this case, Mr Justice Warren confirmed that it was usual for anindemnity award to be made:-

        27 So far as disputed debts are concerned, the practice of the court isnot to allow the insolvency regime to be used as a method of debt collection where there is a bona fide and substantial dispute as to the debt. Savein exceptional cases, the court will dismiss a petition based on such a debt(usually with an indemnity costs order against the petitioner).

          Wish I had seen that first lol...I have used more or less the same information...just missed out the royal mail....and statute barred
