    about 3 years ago, Hubby and I bought a sofa through the now defunct Land of Leather, and took out finance with Creation Finance.

    due to us taking out a DMP, we changed bank accounts, and for a short time were using mine, which Creation refused to take money from a it "is not in the account holders name". After threatening them with legal action they agreed to begin taking payments again, upping the payment from £35pm to £56 pm to "catch up", something we refused to do (not our fault if they admitted they hadn't applied for payments). In June, due to the fact this bill was STILL not being paid, Hubby opened a new bank account and we gave Creation these details, they tried to up the payments to £75 per month (I think the words were it will be a cold day in hell before that happens) and we were given a date of 21/11/2011 as a pay off date (my birthday hence my memory). While we have been on hols, we have recieved umpteen phonecalls from Creation with regards to this account's "outstanding balance" as no one on their end has updated the details. (Again, not our fault) They are now hounding us, we have sent in 4 letters saying that all correspondence must be done by writing, and asked for a statement of account (I can't give you that, the account isn't in your name.. the account holder has to write in). they are denying they have recieved a thing and insist we over them nearly £200 for a paid (to our mind) account.

    What rights do we have if they have simply refused to accept payments?

    UPDATE:

    Since posting this we have received a further 4 calls from Creation, the last of which told me that the calls "would increase until they got Mr R" and that they do not accept written information, that legally they can ignore this and they were legally permitted to contact him "as many times as they want until he speaks with us"
    this is clearly twaddle and I told them I will be reporting them to the OFT for harrasment. according to them they can legally call 6 times a day 7 days a week if they wish.

    any ideas?

      Just received a default notice for over £300 despite being told we owed £200 in july!
      Any idea on our rights as we have given them every opportunity to take payments yet they have refused to take them?
      They have refused a statement of account, ad refuse to tell us when the last payment they took is (we dot need to know that, just pay the amount on the bill.. LIKE HELL I WILL!!!)

      Any advice gratefully received!
