            Disagree about the "without hearing" part

            You cannot dispose of an app for inspection like that, it opens the door for the judge to dismiss it without even hearing your submissions. Its litigation suicide in my opinion and id always ask for a hearing, without question.

            Suppose the judge dismisses your app, without being therre you cant even ask for leave to file a defence within xxx days can you? so you get the order that says app dismissed and then the Claimant enters judgment, thats a real possibility if you dont have a hearing as the time will have passed for filing a defence surely?

                  It seems this type of app needs to be heard, i was just worried that people may do like i did and not read the whole thread and then conclude that was the way to do about things.

                    sorry for the lack of update, work took over as I am from the events industry and Olympics are here... had some problems with replacing the postal order, so finally posted all back to court on Wednesday. Nothing back yet - I assume I should expect reply early next week, will update without delay.

                          Ok. I am back So I tried to call the court on Friday to find out where am I with the N244 notice as I still have not received any correspondence but no one answer so will try again on Monday.
                          Yesterday IND sent me: statement, original signed agreement and T&C's. Letter dated 9th August.
                          The T&c's are unreadable ((very bad photocopy) - 3 pages with cover page, Terms and empty Fixed Sum Loan agreement form), statement has my old address on it (I mean address where I lived before I took the loan - so not sure where they took it from) and the signed agreement - bad photocopy again but definitely signed
                          Shall I call the court to find out what happened and why I have not received any letters from them and find time frame for defence? Call IND and tell them that the T&C's are unreadable and ask for new copy? I will scan all documents and will have them ready tomorrow morning if you want to have a look on them.
                          Why IND is sending it if the case is with Welcome? Shall I ask for Notice of assignment?

                              I am trying to call the court 2nd day in the row, 30 - 45 min waiting and no one picks up. Will try again tomorrow, what shall I do in the meantime? Or maybe can I send them letter?

                                Another few days, another few hours listing to automated message and no one to talk to at Brentford Court so I have e mailed them this morning asking about the status of my application. What else can I do now and what about the paperwork I have received from IND?
