still nothing on the post, shouldn't I get the claim stamped by court? Shall I call the court to double check, and if which one, Northampton or Brentford?

give it a few more days

the claim has been transfered to brentford but call the court (BRENTFORD OR NORTHAMPTOMN) and ask what the suituation is on your claim and the N244 APPLICATION

        REMEMBER

THEY HAVE 14 DAYS FROM THE DATE OF THE N244 APPLICATION, NO WORRIES AT THE MOMENT

Ok, I messed it up, I have received all the paperwork back from Brentford Court, with a note that the court can not issue my proceedings as I have not provided correct amount for this type of application. I have attached postal Order for £85 not £80 pounds and I have not made it payable to HMCTS.

So I have all the paperwork stamped by Northampton court dated 13th July

Shall I quickly re type it, change the date on the N244 form and re post it tomorrow with postal order for £80 payable to HMCTS? Or just attached new postal order to the same paperwork?

I am so stupid I have no idea where the £85 came from (I think I mixed it up as on the claim form the fee listed was £85.

              sign and date the form
Since this has been returned, my advice is to change this to have a hearing as there was a non hearing application recently where the Judge didn't follow what was being asked and that there is binding precedent for disclosure.

The £80 is actually the cost for a hearing anyway (£45 i think without).

Obviously you will need to attend the hearing, or be represented, to make sure you get the points across.

                  mystery1

can you confirm the situation with the dates

do we keep the original dates or new dates as the time is still ticking on the defence and the n244 application has been knocked back

The court will change the dates whatever you put and it's not as quick as you'd imagine.

As long as the application is made ,and the court confirm this, then a defence shouldn't be entered unless the court order it.

so we just keep everthing the same as before, even the dates, but we ask for a hearing this time

                      please confirm

                      many thanks

it was just i did not want him to get a judgement by default through this knock back

Need to fill in number 6 on the N244 and maybe 30 mins for time. Everything else i'd assume to be the same.

Thank you. So I will retype the form, changing Name of the court to Brentford. I will date it 12 July like before (could you please confirm if that' correct)? I will change the postal order at Post Office tomorrow to £80, payable to HMCTS. Under 6. on N244 form I will put 30 min, what shall I put in "is this time estimate agreed by all parties"? Am I right in saying I should put tick "No"?

Leave the dates, not that it appears to matter.

Time - no, unless you have agreed it then yes.
