    forget the above for the moment

    phone welcome in the morning and ask if they would agree to a 28 day extension as to cpr 15.5

    demand they send you an email today to confirm this so you can send the court or you are applying for a strike out

    back up your telephone request with an email

    it is most important we have a paper trail

    if they do not agree/respond with confirmation email as to cpr 15.5

    we go for the strike out tomorrow

      ok, I will call them tomorrow and ask for the 28 days extension, sorry for asking (I do not have any knowledge of the legal system), but why I need the extension?

        welcome will use the change of solicitor as an excuse

        even if we put in the request for strike out, it will prob take three days for welcome to receove it, they then have to send it to you, you then have to do a defence, all in 7 days

        if you do not get an email confirmation tomorrow to send to the court from welcome, we go for the strike out and let the judge decide

                  tell them they have till 4pm to send the agreement to extend as to cpr 15.5

                    ok, so I have spoken to Welcome Finance - at least that's how they answered the phone. I have asked if they agree for the 28 days extension. Person who answered the phone put me on hold and then said that it is up to the court to extend the period. I have said that she needs to agree before I will write to court. I was put on hold again and then was told that person who is responsible to make this decision in not around and if I can leave my details. I have said I need e mail confirmation to be received today by 16:00 and asked for the person name and e mail address. I was advised to e mail enq@ind.co.uk??? They are the DCA who start chasing me! The person on the phone refused to give me her surname when asked. I have sent them e mail, please see below:

                    "Dear XXX,


                    As per our phone conversation today at XX:XX I have asked if you would agree to the 28 day extension as to CPR 15.5. As discussed, I require an e mail confirmation that you (or person who is responsible to make this decision) agree for the 28 days extension, to receive today by 16:00 so it can be forwarded to court in time limits. I have send CPR 31.14 request delivered on 3rd July for which I have not received reply.

                    I just want to mention that you refused to give me your surname when asked for it.

                    Looking forward to hearing from you today before 16:00.

                    Best Regards,"

                    so that's it for now. I do not think they will e mail me back but let's see. What the next step should be?

                        I do not know, but that's what the lady said. She answered the phone as "Welcome Finance" and when I asked for e mail she said it's general e mail enq@ind.co.uk...
