    I hope someone can help me,

    although i'm not proud of myself i'm going to explain a little i am 24 and when i was 18 my parents had a lot of difficulty with money due to a mortgage which was basically illegal in a sense and they are now fighting a course case with it and because of this i took out credit cards to help them baring in mind i had two jobs and went to college nothing was enough they earned around 2400 a month and 1800 of this went to the mortgage, anyway yes i had three credit cards and a catalogue and a few payday loans (bigggg mistake) i got everything for emergencies and my parent told me they would help me obviously they didn't we had our house repossessed in 2008 now i'm in a mess I've paid off a grand worth of debts in the last 6 months and have recently started university and obviously students want student banking with an overdraft now my actual problem is a ccj i signed up to experien about a year ago and noticed i had a ccj and at first i thought nothing of it but then i realized it was issued at my last address so i received no documentation about this and realized i had no idea what it was for although i think its for the sum of £237 it was issued a Northampton county court, so i don't know what to do now i mean can i appeal it or how does it work because obviously i was never given the chance to attend court and give my case as to why i was struggling and now i'm left with this on my file if someone could please give me some advice i would appreciate it very much

    as you have stated

    their was NOT GOOD SERVICE of the claim form as it was sent to a previous address and you were prevented from defending such action

    you need to fill in an N244 FORM from the court and apply to have the ccj set aside

    update your thread when you are ready to procede

    the down side is that it will cost £75 for the N244 applcation notice, but free if on a low income or benefits

      what does set aside mean sorry?

      i went to the citizen advice center today and was told to bring information about the judgement with me on Monday (which i don't have) so was told to print out the credit report with it on!

      i have also had a look again and realized this is not the catalogue i had i only ever had one catalogue but it shows i have two my original one and the one with the ccj surely this is not right, i tried to apply for a student bank account and was approved at first and then the system flagged i had the ccj and declined it this is really worrying

          evening

          set aside means in your case you put in the N244 application into the court.
          a judge will decide on the evidence given in the form to decline or grant the set aside application

          the ccj will struck off your credit files and the claim will then revert bact to the begining where you can do a defence etc

          non service of the claim form as it went to a different address is normally accepted to set aside the ccj

            hi sorry for the late reply, thanks for your advice i went to my citizens advice bureau and they are helping me with it as i need to prove i had no income so hopefully something will happen somewhere along the lines thanks again ill post back if i need anymore help and guidance
